I-130 and/or I-130A?

Timeline

I am a US citizen and am marrying my UK spouse in February in the England. After the ceremony we'll have a short honeymoon and then I'll return home to the U.S. to file spouse visa. I keep reading these two form and I think I understand, but then I don't. Do I file just the I-130 or BOTH the I-130 and the I-130A? And if it's both do I send fees for both? Thank you!

Hi Ann. So from my understand you will need to fill both out, however, your primary application is the I-130. I found this website that is informative https://learn.simplecitizen.com/2017/06/form-i-130-form-i-130a-updates/. You should not have to pay multiple filing fees, I submitted my 1-130 in September and only paid the $535.

Assume you have your marriage visa for the UK already?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes, I have my marriage visa and we declared intent to marry in England when I was there last October.  We're all set for February. I thought it was both forms,  but the spouse just doesn't have to sign 130-A if he was overseas and not able to sign. We'll be together in February though so we can complete the 130 and 130-A and he can sign. So 1 fee for both and I"ve checked the address and in Kentucky I need to use the Dallas lockbox. Thanks so much!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As said, always read the guides/instructions from uscis and visa journey.

 

You are not filing two forms, you are filing only i130 and so only one fee but including i130A as well since it’s needed in your case.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-10: N-400 Sent

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

2017-01-30: Interview

2017-03-02: Oath Ceremony

Thanks all! I have all of the instructions and the examples of the completed 130 and 130-A. I kept reading over the forms and just wasn't getting that the 130-A is kind of a supplemental piece of the 130.
