If you don't file the I-485 within the 90 days of entering the country on a K=1 visa, you are considered out of status and deportable. Saying you have to:"filed AOS within 365 days" is misinformation.

We are talking about the medical validity. Scroll up to the OPs questions above that and to what i was responding to.

You must submit your AOS before MARCH! Or you will need to do a new medical. Can yous MOOCHOBUCKAROOS?"

How is my comment any different than yours?

"I mean when you filed AOS (ie. I485 as that's what the medical is tied to, not I765 or I131) AND received your I485 Noa1 receipt notice, the received date on it must be less than 365 days after the date on your DS3025 in order for your medical to be valid.

Ie. Some ppl wait to file AOS. If they filed on day 364 there would be no way that USCIS would have received it and issued a receipt for I485 so you would not have filed AOS within 365days.

It doesnt matter WHEN you submit I485. What matters is that there is 365 days or less between the received date on the Noa1 and the date on your DS3025" -----and obviously this is still pertaining for the medical validity only.

Ok... I have done SO much research and everything else through our process with y’all’s help.

Our interview date for AOS is coming up.

I was thinking that Form I-693 (medical)

was what my wife did in her country. Seems like that is something that must be done here before the interview.
Is that correct? I can’t believe I totally missed this if so.

(she has done bloodwork and things for a physical here already)

 I am pretty sure we have everything else that is required.

Please help me understand this. So we can get it done ASAP if needed. Thanks!

@Greenbaum

Surgeon General has to fill the form, not just any doctor.

A civil surgeon if you need it.

In our situation we do not need it. The medical examination form done overseas is all we need for medical.
