Timeline

Ok... I have done SO much research and everything else through our process with y’all’s help.

Our interview date for AOS is coming up.

I was thinking that Form I-693 (medical)

was what my wife did in her country. Seems like that is something that must be done here before the interview. 
Is that correct? I can’t believe I totally missed this if so.

(she has done bloodwork and things for a physical here already)

 I am pretty sure we have everything else that is required.

Please help me understand this. So we can get it done ASAP if needed. Thanks!

I-693, Medical Examination of Aliens Seeking Adjustment of Status.I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

 

She has everything she needs when she had her medical in her country.

all we have is one paper signed by the doctor that saw her at St. Luke’s in the Philippines.

 I was thinking this would already be done like you said but after reading it sounds like she has to have one done here also...

From the I693 instructions:

You are not reading that the K1 is exempt if they fit the criteria.

The USCIS policy manual says exactly the same thing.

"4. K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

The medical examination did not reveal a Class A medical condition; or

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27]

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28]

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If the applicant was granted a change of status to V in the United States, [29] the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted."

If you complied with the above and filed AOS within one year of your overseas medical exam date, the I693 and its procedures/policies do not apply to you as a K1 applicant. It does not matter when your AOS interview happens, as long as you filed AOS within one year of the overseas medical exam date (and you meet the above conditions), your medical will never expire.
Submit a photocopy of your personal copy of the DS3025 Vaccination Record with I485 and bring your personal copy to the AOS interview as back up.
Your actual overseas medical exam documents were collected at your POE as they were IN your sealed K1 Visa packet and will be sent from CBP to DHS for storage in your A-file.
Your interviewing officer will collect your A-file for review at your AOS interview or shortly after and confirm that your previously submitted K1 medical exam and vaccinations meet the requirements.

So the two big questions are:

1. Is your DS3025 marked complete? Check the bottom left corner for the checkbox that says "K1 Visa applicant voluntarily completed vaccination requirements"

2. Will USCIS receive and issue you a receipt number within one year of your overseas medical date to have complied with the one year submission requirement?

If yes, you have completed the medical requirements to adjust status.

You must submit your AOS before MARCH! Or you will need to do a new medical. Can yous MOOCHO BUCKAROOS?

 

I am not familiar with the forms as they have changed since I did my wife's. Read the question carefully and use the receipt number you think is the best answer. If wrong, you won't get denied.

Yes. We submitted in May. Interview is February 14th. We are leaving to the Philippines in about a week (She has her EAD/AP) then we will be back in only a few days before her interview so I was freaking out for a minute the way it was worded before seeing the “exemptions” in the frequently asked questions. So we are good to go without a medical.

I mean when you filed AOS (ie. I485 as that's what the medical is tied to, not I765 or I131) AND received your I485 Noa1 receipt notice, the received date on it must be less than 365 days after the date on your DS3025 in order for your medical to be valid. 

Ie. Some ppl wait to file AOS. If they filed on day 364 there would be no way that USCIS would have received it and issued a receipt for I485 so you would not have filed AOS within 365 days.

It doesnt matter WHEN you submit I485. What matters is that there is 365 days or less between the received date on the Noa1 and the date on your DS3025. Get it?

Yes. I got you.

We got the I485 NOA1 2 months after she did her medical. 
So we are easily within the time allowed.

 

 I just totally missed the part of the instructions that you showed me to read.

Thank God, I was about to schedule an unnecessary quick doctor appointment.

With that checked boxed you are good to go with the medical. The one thing I can say about the medical at SLEC they have a reasonable fee and administer all the vaccinations where other medical exam you have to pay individually and they always seem to stick (no pun intended) it to the beneficiary with much higher costs then what can be gotten if done outside. All embassies should adopt this model.

You only have 90 days to marry and file.
