Hi all. 

 

I got married 4 years ago and petitioned for my now ex. It was approved. We have been separated for over a year (which is documented) and divorced (formally) for two months. I met my current partner about 2 weeks after separating from my ex, and it happened that she is here on a J-1, which will expire in July. 

 

My ex is currently attempting to remove conditions with a divorce waiver. I offered my support and provided an affidavit that we just didn't work, but the marriage was entered into in good faith. Our original petition went through consular processing and she waited outside the US. 

 

With that being said, we aren't speaking, and she won't provide me with any of the previous documentation from the two cases that we filed together. (We filed for ROC and then separated shortly after. We thought we could work it out but we couldn't). Will this impact me when interviewing/filing for my current partner? 

 

We are discussing getting married. We knew very early along that we had something special and, unlike my last marriage, I had a chance to live with her before making this decision. 

 

twofold question here: 

1) will having filed for another person (who is currently dealing with USCIS) impact our case? I understand we'll need extra proof, which we can provide. We're not married and we already have joint finances, a car purchase together, we've traveled together, tons of pictures with family, etc). 

2) will not having documentation from my previous marriage cause an issue? 

 

Also, I'm aware of the implications of the previous I-864, my income is high enough to sponsor the entire household, including my ex.

Is she subject to the 2 year HRR?

 

Presumably she of from a different country to No 1?

We have members on 4 and 5 so a second one should not be an issue.
