Living in the States but working for a Canadian Company?

Timeline

Hello,

I received my finance visa & will be moving to the United States from Canada. My current employer in Canada wants to have me continue working from home in the States for her Canadian company. Is this possible without a greencard or work visa?

Should I be seeking legal advise prior to going through with this because I don't want to hinder my Greencard application.

I have absolutely no clue since I am DCF... but congrats on the visa anyways!!! :dance: I'm sure someone will post accurate info for you.

K-1 can work at least for the first 90 days with temp EAD stamp, if you file quickly for AOS and EAD you could continue to work.

My father works for a Canadian company here in the states so that is not a problem, you do need to file and pay taxes earned while in the USA to the IRS and State that you will reside in though.

As the wife of a US citizen, working without employment authorization will not hurt your adjustment of status application.

And if your employer is a Canadian company they may either be beyod the reach of ICE or of little interest to ICE, which has enough trouble trying to monitor US employers.

C. received work authorization with (more or less) his K-1 visa, and his company, a firm in Alberta, is starting operations in the U.S. He'll be starting work with them on Friday.

If you're going to continue to work (by telecommute by the sounds of it) for a company who is based Canada then no EAD is needed. EAD is needed to get a job in America, if the company is based in Canada then an EAD is irrelevant as DHS has nothing to do with who a Canada based company employs.

Note that this is different if you transferred to a US based office of a Canadian company, because then you would be employed inside of the USA and would need an EAD.

We did just what you are thinking of doing. My husband worked for his Canadian company for months while the EAD was being processed. Once the EAD was received he was switched under the US tax ID and was considered working for the "sister" American company.

We actually inquired with my fiancee's company about about telecommuting after she moved for that very reason. The EAD is an authorization to work in the US.

06/17/11 - status change - scheduled for interview

06/20?/11 - received physical interview letter

07/13/11 - Interview in Fairfax,VA - easiest 10 minutes of my life

07/19/11 - Oath ceremony in Fairfax, VA

12/1/09 - received at VSC

12/2/09 - NOA's for self and daughter

01/12/10 - Biometrics completed

03/15/10 - 10 Green Card Received - self and daughter
