Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Even if the embassy check this site i don't have a problem with that , they know the story of us 

So, it's a fake marriage just to be able to "sleep" together?

under islamic law even if i did this in the USA , it is a legal marriage (as many do)

just because it is not registered in Algeria,  does not matter

if it is legal enough for you to sleep together under the laws of Islam,  you are married 

and you say your wife / embassy picks up on these things

you have put yourself between a rock and a hard place

If you say married enough for a child under islamic laws ,  you are married

embassy can approve your K1 but if later it is discovered you married in Spain and just could not register it in Algeria (and i understand all this) from my Algerian friends), you can be in serious trouble with immigration as lying on application

if you withdraw it now, and correct this mistake saying you did not understand about marrying outside your country and you need to do CR1,  you can be forgiven

please,  the laws of Islam  prevail in this issue and in your country

also the laws and rules of immigation

i am hardest here on VJ to members such as myself as i had to follow moroccan and Islamic laws to marry,,  USA immigration laws for the visa

I am not saying all this to discorrage but to forewarn you of serious issues you are making for your visa (whether approved or not)

 

the VJ community supports each and every member

we want you to succeed

we understand you love your wife (gf) and need to see your child

 

and you should note no other Algerian is talking here but they do note this post 

and you know what algerians are like so you need to heed what you say here and think about all that is said

After you get denied for being married in Spain, you guys file a I-130/I-130a and wait a year, two or three for the correct visa.   A marriage of any sort is married in the eyes of USCIS.  In fact you can look and act too married while being single.   You call her you wife - you are married.

 

USCIS might have to determine if you misrepresented yourself on the first petition. 

 

Have you wife join here too would be a good idea.   Immigration is not a game.  You words and actions have meanings.

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

In your opening post you called her fiancee now all of a sudden she's your wife?

Make up your mind what she is to you per law and then file for the correct visa.

If you got married in Spain then USCIS will see you as married which means you filed the wrong visa.

K1 is for people who want to get married, CR1 is for people who are already married.

ROC Timeline

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

  • OP, sorry to say, but your K-1 will (rightly) be denied.  You are ineligible for a K-1 as you are married.  Your wife should petition you for a spousal visa if you still want to immigrate to the US.
