You must I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed ..

After you get your temoprarily green card ( 2-year green card), you can travel out of the united states without any documentation, just be back before the 2 year green card expires.

Thank you for that reply Loonphang. I heard there is rick they may deny re-entry. Is it true? And is this with the AOS or the removal of conditions? Thanx.

If you leave the country without AP before your AOS is approved you will have abandoned your application and therefore denied re-entry.

Once you have your greencard even with the conditions, you may travel wherever you wish. Just dont stay out of the country for longer than a year or contact state before you leave if you plan to spend longer.

Henia, you would have to apply for I-131 (Advanced Parole) and have it approved before your spouse could even contemplate travel outside the US before AOS approval. Once AOS is approved and your spouse has the green card, travel won't be a problem. However, you cannot apply for Advanced Parole until you have married and filed AOS. The informtion about the I-131 is in the Guides section. :)

What visa is your spouse here on? If it's the K3, it's multi-entry and he/she can travel without getting approval beforehand. I wouldn't, however, once the green card is received, stay out of the country more than a year or they will take the green card away. This is written in plain English in how to maintain your green card.

K3 is multi entry! BUT!If you have a AOS interview and they take the I-94 from your PP you aren't going [can go but no return] anywhere without advanced parole.

You have to wait for your GC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

From what I understand if you have an interview for AOS and it's approved, they take the I-94 and stamp the passport with the I-551 stamp. That's like a temporary approval until the actual green card is in hand. However, I could be wrong.

They took my wife and a daughters I-94 at the interview and told us they'd have to get AP if she wanted to leave and return to the US until they got the GCs. Maybe they do things different in Hawaii!

Surprised me as I'd thought K3s were multi entry for 2 years or untl GC was received.

Another reason K3s suck!

They *sometimes* do that, and its getting rarer. In my interview I asked for a I-551 stamp and was curtly told that "we don't do that any more" and I'd be getting my Green Card in 2 weeks. Ironically it actually took 2 months to get my Green Card, for no apparant reason.

So with that being the possibility, would the OP need to file AP?

AP becomes invalid if AOS is approved I believe, so an AP wouldn't do you much good in that waiting period between being approved at interview and your GC arriving.

Henia,

Your husband seems to be applying for an immigrant visa? In which case there is no adjustment of status?

Or is he switching to a K3?
