Part 5 I-864 Question

Timeline

I-864 Section 5 says: do not count any member of your household more than once. It says provide the number of immigrants you are sponsoring which is 1, my husband, who I am married to. But then it asks again to put 1 for my spouse. What should I do?

You enter a "1" on line 3, ONLY if your spouse is NOT the one being sponsored

We had the same question and our lawyer said to leave "0" because this question is in case you were married and sponsoring your mother or someone else from your family.

So "1" for yourself and then "0" for the question 3.

That way in the total for your household size it will be 2 (1 and 1)

USCIS - FILING FOR I-751 (CR1)

May 21st 2022 : package sent (with Fedex / Delivered on May 23rd) 

May 27th 2022: case received with Receipt # (NATIONAL BENEFITS CENTER)

May 31st 2022: NOA received. I-797 (24months extension)

June 11th 2022: NOA for a Biometrics appointment (set for June 30th - need to reschedule it - not in the US on that day! 😱)

June 14th 2022: walk in at the Center - all went well. Biometrics done!

December 8th 2022: Received a Notice of Action. I-751 APPROVED! 🎉

December 10th 2022: New GreenCard received in the mail 🥳

Just to be sure: you are sponsoring your husband, right ?

Then in that case, my response above is correct :)

So, then since the section to enter 1 for spouse is under the heading of "persons not sponsored...."   Note, you are seeing two instructions there.  One not to count anybody twice and a form heading indicating people below that line include only people not sponsored in this affidavit.  The preceding two instructions trump the third one telling you to enter 1 if married.
