Unless I'm missing something, I can't see that OP has confirmed that the question about current usage was answered honestly...?

I think it was more inferred than stated directly.

I'm not getting an inference either? When OP was asked if they were honest about current drug use, she answered that it was 10 years ago and they haven't been in trouble since...while having already stated marijuana is currently smoked...

 

So what I infer from that is that OP didn't actually answer anyone's question about whether the CURRENT drug use question was answered honestly...and instead referred back to the prior drug use that resulted in the conviction...

 

So if anything, I would more likely infer that the current use question wasn't answered honestly...which obviously changes thing, re whether a waiver would likely be granted...

Just to elaborate on that - I don't think the OP has implied anything, either was...but I also don't think the answers and info available lead to an automatic inference that the question was answered honestly...and based on what I've read on how the embassies normally react to current drug use, I'd expect it's probably more likely current drug use wasn't admitted...

Well she said he has not been in trouble since and committing perjury would usually be described as a type of trouble.

Same...as OP stated that he currently breaks the law by using an illegal drug...but doesn't count that as 'trouble'.

OP, just to be clear, I'm in no way judging your partner for smoking weed - most people I know do - just trying to work out what was said on the form, as that may explain why the waiver was given. Good luck to you both in getting the visa! 🙃

Like many people with a partner that breaks the law she makes excuses for him. Right from the start she said the drugs weren’t even his. So he only gets caught with other people’s drugs, never his own. How convenient.

Depends how you look at it, I guess...'good character' is VERY subjective. I count myself as having good character as I help animal and human charities and rescues, visit OAP homes, give up my seat on the bus, carry people's shopping, etc...but when I discovered Tesco had over-refunded me by a tenner, did I drive back to return it...I couldn't possibly comment 🤣.

but

its not subjective in immigration terms... they have very defined specifications for what (doesn’t) count as good character, and drugs is one of those things.

Absolutely...just throwing out there that OP won't necessarily be using the same yardstick as the embassy, re what defines good character...

I think it’s very important that OP answers directly and clearly: Did the applicant answer honestly (“yes”) on the Ds160 about his current drug use or not?

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
