OP we are correct to assume this was answered truthfully?

 

Unfortunately the US is very unforgiving of drug violations. You’re lucky that he was even recommended for a waiver in the first place.

Good to hear, lying on the application can have much more serious effects.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She was asking about the current drug use. How was this question answered on the DS-160?

Well it is not common but has always happened to my knowledge where there could be a specific issue the Consulate needs additional guidance on, as in this case. The CO's are not medically trained.

I think it's worth pointing out that cannabis is a Schedule I drug on the same level as heroin, lsd, and meth. That is the highest classification by the US government. In fact cocaine is lower on the schedule than marijuana. If he fails the drug test he is unlikely to receive the visa.

And yet the CO approved him for a waiver despite admitting to current use of marijuana (OP confirmed that this question was answered truthfully on the DS-160).

Generally for immigration only one offense of possession only (<30g) of marijuana longer than 15 years ago is waiverable; like I said, with 10 years for a class A drug, he’s lucky.

Because he hasn’t been caught. By your own admission he has repeatedly broken the law since then and continues to do so

(you said he “smokes”... present tense).

I’d say it’s because he noted on the application his prior charges.. 

 

likely they wanna test to see if he’s clean and learnt his lesson..
