So we got k1 approval right before Christmas and fiance is coming end of February. Marriage set for March 21st I have to apply for green card. What does this entail and how long does it take to get green card? Also my fiance could get the opportunity to still work for her company since it's a US business. They could sponsor her with a work permit. Is this possible while waiting for green card? Have a lot going on and heads spinning. Any guidance would be great.

Thanks

Slow down Y’all need to get married first then file for AOS, AP and work authority right after getting married. likely 4-8 months after married, before she can work, leave the country or get green card..

joys of k1

Not in a super rush but her company offered a job. So it could benefit her to work sooner. So my biggest question is it possible for her company to get a work permit for her to continue her job here in the states after our marriage? She would like to continue her job and not wait.

Well if they have a blanket L1 they could file for her.   Doubt it would be done in time.

File the AOS with EAD/AP as soon as you can after marriage.   Once you have the NOA you can ask to have the EAD expedited with proof of the job offer and that you are suffering an economic loss by her not working.

First of all. Your fiance is the one applying for AOS, not you.

She won't be able to work until she gets EAD. She will apply for that along with AOS. I might be wrong, but the company won't be able to sponsor her a work permit while she adjusts status.

What she can do though, is expedite her EAD application with the job offer. It will take a good 3 to 4 months after applying for AOS.

Ok thanks for the info. I was really wondering if they could supersede the process. This is the US government.... God help us!

Not suffering economically other than her having to sit at home. Lol

You could also use "phycological benefit" . . . but "economic loss" they accept.  I know if my wife couldn't travel or work she would have driven me crazy.

Without economic hardship it will be difficult to get the EAD expedite approved, but you can always try, no fee no risk.  Hopefully her company is willing to keep the job offer open while you try for the expedite.  Good luck with your marriage and her adjustment to life in the USA!

as others have implied, your fiance is entering on a K1 therefore has to go through the K1 > marriage then AOSEAD process. It seems most people get their EAD within 4-6 months once EAD is applied for. So if you marry in late March and get your paperwork in optimistically she`ll get EAD by around August... no promises though that assumes smooth sailing and relatively fast (but realistic) processing. Its a ballpark date though that you could plan around.
