Where in my I-130 packet should I put name change docs for my foreign spouse?

Timeline

I am a US citizen filing for my Canadian husband. When he turned 18, he had his last name changed from his father's to his mother's.

I have a copy of name change certificate, but I am unsure where in the packet to put this, or if I even need to include it at all.

His Canadian passport, driver's license, etc. are all under his current last name, but his birth certificate has the former name.

Definitely include the evidence of the legal name change.  I'm not familiar with the I-130, but is there a space to list former names?

 

Personally, I would attach it to the copy of the birth certificate so that it is clear that his birth name was changed.

Sorry if my question wasn’t clear enough, but I would like to clarify that the name change was for my husband, the beneficiary for whom I am filing the petition for. On the I-130A (the form we filled out with his information as the beneficiary), there is not a space for former names like there is on the I-130 form, hence my confusion.

 

There is no divorce involved with our case, also. His name change was not related to marriage in any capacity, and happened long before we were married. Also; correct me if I’m wrong, but I don’t think I need to include a birth certificate for him?

No you don’t need to include his birth certificate, yes include the name change document. His previous names are asked for on the I130 so the name change document still needs to be included and his former name disclosed on the I130

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Correct.  Just place the name change documentation any logical space in the stack.

You will need to include  the name change document and disclosed his former name on the I30.

To me, that's not logical.  A logical place would be higher in the stack, like between the I-130 and I-130a, or just after the I-130a.  It is NOT evidence of bona fide marriage.
