IS RESIDENT GREEN CARD HOLDER ALLOWED TO MOVE UNDERAGE CHILDREN TO THE US

Timeline

Hello,

I am the US Citizen. My hubby is the resident GC Holder. We are married since 2012 and are now ready and wanting to bring his 16 year old daughter to the US to live with us. How do we accomplish this? I am looking and am having a hard time understanding ALL the info I am finding on the USCIS website. 

Questions?

Is this allowed?

How do we accomplish?

What is the time frame? ish

The I130 is confusing me-

Part 1 says Petitioner.

Am I the petitioner? Even though the child is not my biological child?

Part 2 goes on to ask my A number so I am assuming the Petitioner is my husband the Resident GC holder.

Yes you option your step daughter and therefore you are the petitioner. 

Just write none.

Be prepared to show that the other parent has given permission or a court has allowed the child to immigrate..

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes, you are the petitioner. The child is the beneficiary.

In the I-130 the step-children are called child (as if they were your own. You don’t have an A-number I assume as you’re a USC petitioner and neither has the child unless she’s been declared an alien at some point.

 

I suggest you read the instruction to the I-130 where it is explained more or less step-by-step on how to fill out the form.

I-130 approved: 05/21/2020 —> NOA2 came from Texas Service Center 🥳❤️

Case Number received: 05/22/2020 —> via Email 😃
Paid IV and AOS fee: 05/23/2020
IV fee processed (AOS fee is stuck😭) 05/28/2020
Submitted IV application and civil documents: 06/02/2020
Submitted inquiry to NVC for AOS fee being "stuck" (known NVC system issue): 06/02/2020 --> Let the waiting begin - again.... 
AOS fee finally marked as payed: 06/10/2020 🥳

Not with the petition. The child will need that for the interview. Had the other parent already agreed to it?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

To those following

For the USC to petition for a step-child, the marriage to the biological parent had to be before the child turned 18.  If you marry somebody with an already 18 year old kid, that one does not qualify as the USC’s “child” for immigration purposes.  The Permanent resident biological parent can apply for them but it will take longer because only so many can get a visa per year. Once the child turns 21 or marries, they are “Son” or “daughter”, not “child” for immigration category.

We filled the I-130 online on January 22, 2020.

Process will still take you about a year or so.
