hello everyone,

 

today 1/16/2020 i was scheduled for my N-400 interview at 1:15 PM, i showed up, waited and then they took my picture and fingerprint, the second time i was called and the white guy took me to the separate room and told me that he won't be taking interview from me today because my I-751 is "still not approved and still pending and myself i have received another letter from USCIS about the second time fingerprint for I-751 " two days ago, it is confusing situation, they didn't take care of I-751 yet and they scheduled interview for N-400 for me, the guy told me that after decision is made about my I-751 then they will scheduled my interview again either in the end of the February or in the beginning of march , my question is " is this normal has this been down with someone else or i am the only one, i am a little worried, whats going on?

 

P.S: i am still married to the same spouse and we have one daughter

I happened before, not too often though. I've seen this in some cases. What's more often is they would do a combo interview I-751/N-400 all in one and they could approve both. Obviously did not happen in this case. You can only wait and keep dinging them on the I-751. You could have asked "the white guy" to see if he could pull the I-751 and adjudicate that.

I had this happen at my N-400 last year..... waited around for four hours, but their excuse was confusing and I still can't work out if it was because of the still pending I-751, or part of my file being misplaced that they alluded to when telling me it was cancelled.

 

Either way, it is now almost exactly 365 days later and no sign of a reschedule (despite being told that it would be expedited and multiple attempts, service requests and infopasses to try get this done) and no movement on the I-751 either..and both the I-751 and N-400 are now classed as outside of processing time now.

 Standard USCIS BS basically.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

But yours also has all that snafu happened to the first I-751 right?

Shouldn't be an issue...should be in the same A# file, and each I-751 is reviewed and adjudicated on its merits.

Besides, lack of evidence was not the issue or the reason for denial with the first one!

Ombudsman were zero help -  told me to speak to a lawyer - and senator, no reply.

Should have entire contents of my A# file in a few weeks when my FOIA is completed (it helpfully gives you an estimated completion date in the request portal once filed) and once I have reviewed that I am thinking maybe writ of mamandus time... this has gone on long enough now, given the first I-751 was filed a few months shy of five years ago now....

 

 

Anyway, wasn't trying to hijack the OPs thread. 

Not much you can really do - if you call or write request a new date, you will get the standard 'in line for rescheduling, cannot give you a date for this' pro-forma response or a variation of it. You can't speed up the I-751 and can't file for outside of processing time until it is. 

 

It is stupid as they are supposed to be adjudicated together, and a pending I-751 is not a reason for cancelling an N-400 interview, which can proceed and be approved in principal but just not be formally approved until the underlying I-751 is. They are supposed to be combined, and this standard procedure happens all the time . I would possibly hazard a guess that being from Pakistan may have left you subject to additional scrutiny & delays and they are giving you lame excuses 101 as is standard for USCIS , but that is only a guess....

Allow to file, yes, allow to be naturalized (ie. be approved and do the oath to become a citizen), that depends on specific circumstances----From USCIS policy manual:

 

2. Spouses with Pending Petitions and Naturalization Applications

An application for naturalization may not be approved if there is a pending petition for removal of conditions. If an applicant’s petition to remove conditions is pending at the time of filing or is filed prior to the interview, USCIS will adjudicate the petition to remove conditions prior to or concurrently with the adjudication of the naturalization application. [6] 

 

However, certain CPRs may be eligible for naturalization without filing a petition or having the conditions removed if applying for naturalization on the basis of:

  • Marriage to a U.S. citizen employed abroad; or

  • Qualifying military service. [4]

OP hasn't said that he/she fits either of the above two mentioned criteria.  What's interesting in this thread is that the OP did not have a combo interview....perhaps something to do with the delay behind the 2nd fingerprinting/additional background checks.  Shame the officer did not/could not pull the i-751 and adjudicate it on-the-spot, as what normally happens when this situation occurs and there is a pending i-751 behind a pending N400.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
