FB-4 Visa Question

Hello,

 

My wife is a soon to be naturalized citizen (fingers - crossed).  Once naturalized, we would like to bring her brother and his wife here. 

 

Any experiences that an be shared before we embark on this would be greatly appreciated.

Well, you need to be aware that it is likely to take 15-plus years, maybe longer, for them to get their visas once the application is filed.

After citizenship just file and wait and hope the laws don't change.

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Timeline

Spouse and children are an issue for when the visa number is current and will count as beneficiaries.

 

Usually a straightforward process.

Spouse is never an issue. Children may be if they age out, but no children mentioned so assuming they don't yet exist/will be born at a future date, they are unlikely to have aged out by the time a visa is available unless things slow down far more dramatically than most expect.

What are the chances of a spouse now being a spouse in 20 years? Death or more likely divorce could intervene.

It's still not an "issue", a straightforward they are or they aren't a spouse at the time.  Not the same issue/decision as whether to leave your aged-out child behind.

 

i assumed young couple given no children yet, could be incorrect assumption of course.

Absolutely, but they have to remain in status, on what basis will they be looking to wait in the US?

The F4 will not be available until their Priority Date is current. Investment, work?

Only if they have another valid status to wait in the US on, I am not aware of any non-immigrant status that allows one to wait that long. Longest is H1B with 6 years max AFAIK. So the short answer is no.

investment visa was mentioned above, if they have the capital (i think it has gone up to $800k? used to be 500) they can get green cards via an EB5 visa, much faster, around a year to process i believe.

E2 is non immigrant and can be renewed indefinitely.

 

Seem to recollect a lady who was here on a F1 for a very long time, certainly more than a decade.
