Divorced from K-1, want to marry and file IR1

I was with someone for 10 years, we met overseas and I then brought him here under a K-1. We separated right after he received his 10 year card. Do I need to let USCIS know? Also, am I eligible to petition for marriage for someone new? Our divorce has been final for a year and the marriage hasn't happened yet, but looking toward the future. Should I attempt to contact USCIS (their phone menu is impossible). Thanks!

There shouldn’t be any issue getting a CR1/IR1 for a new spouse as long as you have sufficient evidence and related paperwork. Just remember your I-864 / sponsorship is still active on the original immigrant, regardless of marital status until they do 40 quarters or become a USC. Sometimes things don’t pan out in life.

As long as you are free to marry that is all that matters to USCIS about former marriages.
