we got married 21th Dec, and i went and file for SSN thought i should get it before filing for AOS

Called the office today to track it, and was told that somehow this is the slowest time of year, so it might take up to 3 months to issue one

 

i apply the SSN with my maiden name because the office would not take my temporary marriage certificate for the name change. so i would have to go back again for name change later when i get the SSN. 

 

my question is, can i then file for my AOS without SSN? or i have to wait till i have the SSN before making any further application for anything...

While the form has a box to input an ssn if you have it,  nowhere in the instructions is it a required entry.  In fact, there are many AOS applicants (non k1) who are not even ssn eligible until they get EAD

You do not need a ssn for the AOS application. Get it in ASAP. Depending on when your I94 from your K1 visa expires, you may or may not be successful in getting your SSN now

I dont even plan on getting my work permit since my K1 will be expired in March... i dont see a point apply for it and valid to work for 1 month?

Your EAD I'm referring to is the one you file based on the i485 not the short term k1

EAD doesn't have anything to do with the K1 expiration.  The expiration it the time you have to enter the US.   Your K1 Visa "expired" the day you entered the US.

 

If you have more the 15 days left on your I-94 you can apply for a SSN.  Otherwise you can get one after getting your EAD or green card.

EAD doesnt expire when at k1 VISA expire day? OMG then i guess i got the info wrong... thought i read it somewhere that it come with a expire date (Same as the one on K1 visa).

The expiration date on the visa is that date that you have to be in the US by.  Once you enter it really means nothing.

 

Technically you can apply for an EAD on K1 before marrying but it expires on the 90th day in the US - the date you have to marry by.   A decade ago you could get a EAD in a few weeks.   Not so anymore.

 

The EAD that you apply for in the AOS package will expire when the Green Card is issued.

so say i apply for the EAD now with my AOS, and even tho the expire date on K1 visa is in March, and i could not get a greencard issue before the date passed, i could still continue using this EAD ?

Just apply for the EAD in the AOS package.   With it you can work and get a SSN.   Once the green card arrives you no longer use the EAD.   Your Visa expiration date no longer matters.

When you apply for EAD based on a pending AOS, the card is valid for 1 year, or until you receive a green card, whatever comes first. 

 

Of the green card is taking longer, you will just renew the EAD

 

And remember, it's FREE when you apply together or after AOS.

SSA told us to take a hike until we were fully processed through immigration.  I really don't know how some have pulled off a social beforehand.  Anyway, we just got approved and are waiting for the GC.  Once that comes in the mailbox, bright and early the following morning we will be in SSA's grill to get her a social security card/number.

Congraz on approval of AOS! so you did not apply for EAD with AOS? if you did that you should have been able to file for a SSN the same time as they issue your EAD...

We did apply for EAD and AP but it was still outstanding when we got approved for the GC.  We should be all set soon.
