Hope everyone doing great. I have couple of questions and hope someone will answer asap 

 

1. What is visa category for unmarried 21 or younger child of permanent resident? On uscis approval letter its I-130 and on nvc website its coming up F22 , It would great help of someone can guide me where i can find visa category.

 

2. Can someone calculate CSPA age for me , i try different website and its coming up different 

Here are details:

Date of birth: 12/07/1996

Priority date : 06/13/2017

Approval date: 08/03/2019

Visa current bulliten date: I dont know what is this

1. It is F2A, which you will see as F22 on NVC site. ( I130 is the form that you were petitioned on.)

 

2. Visa bulletin current date is the date of the visa bulletin in which your priority date became current, for you that was June 2019.


your CSPA age* when visa became available (which was after approval, so August) was 20 years 6 months. Have you submitted a DS260 yet? 
 

*i am assuming all the dates you posted were US format mm/dd/yyyy.

your current CSPA age is 20 years 6 months. Have you submitted a DS260 yet? 

 

Thanks for response yes i submit every thing  including DS260 and pay all fees as well. All documents were submitted and  reviewed by NVC on 24th october and there was only typo error in one form 864A  so we fix it and resubmit on 28th November . It was over six weeks and we did not hear any thing.

I submit expedited request through senator on january 08 and got approved on 13 January so case is transferred to embassy.our interview is scheduled on 31st of this month and lets see how it goes. 

 

I check with attorney today and she said its over 21 by date of interview. I am not sure how attorney is calculating

It doesn’t matter what your age is by the interview, as long as you were under 21 at the time the visa was available and you “seek to acquire” the visa (which you have done by submitting a DS260, which was why I asked) within one year of the visa becoming available.  This is referenced on the official USCIS web page on CSPA (I’ve just deleted the stuff not applicable to your visa type or processing):

....your CSPA age is calculated by subtracting the number of days your petition was pending (pending time) from your age on the date an immigrant visa becomes available to you (age at time of visa availability). However, you must remain unmarried in order to qualify.

Age at Time of Visa Availability

The date the visa is considered available is the later of these two dates:

  • The date the petition was approved; or
  • The first day of the month of the Department of State Visa Bulletin that indicates that a visa is available for you in the Final Action Dates chart.

Sought to Acquire Requirement

In order to benefit from CSPA as a family preference ....applicant, you must seek to acquire lawful permanent resident status within 1 year of a visa becoming available to you. This is referred to as the “sought to acquire” requirement.
