EB-3 visa for an Australian?

Hey all,

 

So I've been interested in working in the US, potentially for an extended period of time (depending on how well I adapt and enjoy it).

 

For Australians, the E-3 non-immigrant visa seems to be touted as the ideal choice.

 

However I'm curious about going for an EB-3 instead, for the reason that it's an 'immigrant visa', and as such, opens the door to potential Green Card and Citizenship.

 

I heard there can be a longer wait time for the EB-3 and the hiring process might be more complicated. But apart from that do you think an EB-3 is any less likely to be achieved than an E-3?

I'm not in a particular hurry, though I wouldn't want to wait for some crazy amount of time like 10 years.

 

What do you all reckon? Are there significant advantages to the E-3 visa over the EB-3? And if so, what are they?

EB3 is an immigrant visa and gets you a Green Card, so you are not tied to an employer, a E3 is a work visa.

I am not too sure about E-3 but I am assuming both E-3 and EB-3 should have a job offer to proceed. Once you have a job offer, ask for company sponsorship to apply for either 1.

 

I think E-3 is to be renewed every 2 year,  indefinitely but you need to hold on to a job to remain that status. As for EB-3, once you get approved and moved on to Adjustment of Status to GC, you do not need company sponsor anymore. Another difference is that under E-3, your dependent spouse can work, under EB-3, during application, unless spouse has her own status, under your dependency, spouse cannot work until it is approved and her application of EAD is approved. Should be at least a year or so.

It’s much easier for an employer to sponsor an E3. You are correct that there is less certainty, but it’s easier to get in the first place, so that’s the trade-off. Does depend on your appetite for risk - I have an Aussie friend who was let go from her E3 job about 6 months after arriving in the US. Just her and her dog, so not too disruptive to just go back home, but I imagine it would have been a big hassle for a family.

Also for Eb-3 you will have to come here under some other visa like F1/H1b/L1 unless your employer is willing to sponsor you for Eb-3 and wait until you get your green card.  If you are applying H1b than you will have to compete for a lottery and see if you get through the lottery. Once you get H1b you can request your employer to file for Eb-3 green card.   

 

For Aussies E-3 is the way to go.
