J1 exceptional hardship waiver

HI --- GUYS , USCIS SENT MY file - i612& 3 were sent to DOS Tin 01/2021. but  DOS did no-show any  I612, I 613 UPLOADED , so upon inquiring through sensors office after months DOS responded saying that they have not received  IT TILL 08/2021 , USCIS confirms again that they send it in JAN 2021. I AM SO STRESSED WHAT TO DO NEXT. anyone knows anybody, who had dealt  with the same problems . any suggestion I will really appreciate it thank you .

If you want, you can try again with DoS and show them proof from USCIS that they did send it. If DoS keeps saying we have nothing, then you have to pressure USCIS to resend it. It won’t take 8 months. Your I612 is already in their file. If they collaborate with you, they can send it the same day. It happened with me, and USCIS kept saying we did our part and it is DoS’s fault. I had to get a senator involved and then USCIS resent it within 24hrs. 

hi , how long were you waiting before requesting USCIS to resend and also once USCIS resend it how long did it take for DOS to get it an upload on their website and did DOS was requested to expedite the processing ? how long before you got your final desition from DOS ?

Once USCIS resent I612, the DoS website was updated within days. I am still waiting for DoS’s decision, nine months later. They don’t approve expedited requests. They haven’t been responding to my emails nor to several congressional inquiries.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry to hear this. I will call USCIS and request them send the mail again. My case is with DoS past 8 months and haven't heard anything back, so be prepared to wait at DoS as well. Please call USCIS and request them as soon as possible.

i applied for a J1 hardship waiver based on exceptional hardship to my US citizen child. The I612 and I613 has finally reached DoS after 6 months (please see it below). 

My questions are;

1) In my case will DoS ask for sponsor views? I see it is mostly done for people with fulbright scholarship. Can anyone please confirm? I am trying to judge how much time it will take. 

2) Does anyone know how long it will take from here on to get the waiver?

3) Can I stay past my grace period if I receive the waiver but without having a job?

4) If I plan on staying past my grace period and a new employer files for a H1b, can I change my status here in the USA or do I have to go out of the country and get the H1B visa stamped on my passport?
