You can file as soon as you are legally married.  Any obstacles would have to be overcome with the CR-1 as with the K1.

I've never used her services, but I do know she is well-mentioned around here when it comes to dealing with waivers.

We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. First step after the K-1 denial is to try and figure out why the visa was denied.  Knowing the reason(s) will help you to overcome them if you move forward with marriage.  Then if you think the reasons can be overcome with more evidence like visits to spend time in person, or a waiver, get married in Nigeria or some other non-US country and file for a CR-1 spousal visa as soon as the marriage certificate is received, together with the additional evidence of time spent together and financial co-mingling.  Do more research on what it takes for a successful spousal visa from Nigeria, it is a high fraud country.  The CR-1 process takes a year or more before a visa interview will be scheduled, depending on the USCIS processing center the petition is sent to, during that time you'll have more opportunities to spend weeks or months with each other in Nigeria for visits as more evidence of a bona fide  marriage.  At the interview, if denied for something for which a waiver is possible, they will tell you at that time to file a waiver.  That's when the attorney might be helpful, in filing the waiver for misrepresentation.  The waiver process can add 6 or more months to the process, so you're looking at at least two years if all goes well, maybe more.  Good luck!

I don't know anything about waivers(hopefully won't have to), but my lawyer referred me to an "immigration attorney" since immigration isn't his thing, for my K-1. I had a few questions, nothing very complicated, just to see if I would be better off using an attorney. He didn't have any information that I didn't already have from research on my own and from this site, and was clueless on a few other things. It seemed like I would be doing all the work anyway and just paying someone to fill out forms.

 

It sounds like your situation might require more expertise and you might benefit from using a lawyer, but if you can do it yourself, do it.

 

Incredible waste of $200.00 for 10 minutes and 3 emails.

Misrepresentation in what way? Was it a denial based on not being able to prove a bonafide relationship (and you're using the term misrepresentation)----or was it a case of false documents submitted, lying under oath, etc.?

Agreed. Waivers are one case in which a good attorney can really be useful. A well prepared/presented packet with evidences is beneficial. Every waiver decision is discretionary.

M tourist visa many years ago was filed as married because I was livin with my boyfriend then. During the interview, the co asked me if I’ve been married before, and I told him no. Then he was who the person on my previously filed visa is, I told him he’s my ex. And we lived together. We were planning to get married and it didn’t work out . Then he said he’s refusing me the visa. I was with my spinsterhood cert, but he didn’t ask for it. When I ask him what I shld do after he refused the visa, he said I should contact my lawyer or talk to my fiancé.
