The funny thing is that she is not from a third world country, she is from Finland

I know of a case of fraudulent marriage and that an email was sent to immigration reporting and they sent their i130 two years ago and Immigration have done nothing. That person is still in the fake marriage and must already have his residence Then nothing to do in this case he already has his residence of 10 years...
just get divorced as soon as possible and get on with your life.Good Luck !

We see cases like this all the time here on VJ.  A marriage breaks down for whatever reason, and the USC spouse, in the emotional heat of the moment, immediately seeks revenge by asking how they can report marriage fraud to USCIS or ICE, how they can "have their spouse deported."  Having gone through one divorce in my life, an experience that was difficult but a significant learning experience, my recommendation is to not seek revenge, but seek a divorce with respect as the constant theme.  Find a good divorce attorney, one that practices with compassion and sensitivity, and start the process of divorcing her.  In a very short marriage with no children under 18 it should be pretty simple depending on the state.  Forget about the immigration part of your wife's journey, she can stay in the US if she wants to as an LPR.  Move on and try to put those feelings of anger and revenge out of your mind, as hard as that might be given your circumstances.  Don't let this negative energy dominate your life, that will only hurt you.  Seek help from a good attorney and maybe a personal counselor so that you can heal your mind and soul and move on without her.  Who know, maybe you two can be friends even after a divorce?  Focus on the good times you shared and not on the bad ones.  Learn from this experience, take the high road, become a better person because of it.  Good luck!

I've read several cases of women fraud that marry only for the green card. And I see that women can be more manipulative and calculating than men. So I hope these cases serve a lot of men who believe that the woman is in love!

My x-husband definitely only married for a chance to stay in Denmark .. immigration just doesn't work like that there and he is not the only man doing that or marrying in order to have a house-slave ... this works both ways.

Surprised some one from Finland would want to stay in US without the relationship part 😳

Maybe it was fraud, maybe not. Doesn't matter now as there appears to be no (useful) evidence of it. Move on, and get a good divorce attorney.

If you have proof of misrepresentation you can go USCIS And ask her to be removed. But if you have not proof you have to live with it. I’m so sorry to hear your story. 🥺

it seems like the fact that she never came to live with me means noting, I thought this would show them that this was fraud.

That, with more direct evidence, could bolster your case.....But alone, I doubt it would be cause for USCIS action.  It's time to stop the pity party, look forward, and move ahead to find happiness for yourself.....Let her go....Her destiny is in now in her hands.   and your destiny is in YOUR hands.....

It's possible that they look into her case to see if there was fraud if she applies for naturalization or to petition somebody else (especially another spouse). Not likely IMO, but possible.

But there is nothing for you to do.

Not on it's own, no.

about a month ago we started fighting because I told her that she misrepresented herself and I told her not to come, that I will withdraw her petition.

before I could do anything she arrived in the US, I don't know where she is staying and she clearly changed her address and received the GC there.

At that time she had the visa approved, was close to flying out, and knew there was no withdrawing the petition at that point from your end.  She seems to have a handle on how the process works since she knew to change her address to get the card mailed directly to her.

She is now saying that she is afraid of me because I am a violent person and that she never want's to see me again.

People intending to deceive normally pull the abuse card when ROC or AOS is in play, not when they already have the 10-year GC...unless there is anything in your past that would have led her to make this sort of statement to you.  Hopefully your text messages to her haven't been threatening in any manner...even if done in the heat of the moment, it can backfire on you should that continue.

I can see an IO briefly questioning why she never seemingly lived at the same address as her spouse but it would be likely more of a few minutes fact-checking exercise than anything really in depth since she'd be applying under the 5-year residency rule...and not marriage-based.

Can be easily explained away if she claims she immediately moved to a different location for financial reasons/her spouse separated from her soon after entry---If this was all a scheme, she may be waiting for the USC to be the one to move towards filing for divorce instead of her to further show she's not the one pulling the trigger, so to speak.

Oh I know :)

I was just thinking (when I wrote the above) that if the wife had had to go through the ROC process, it would have been questioned more at that point that they don't reside together---if it was a scheme, she was smart to delay entry until she was eligible for the 10-year card to skip that part.

Not to say it can't all fall apart for her in the end during the N400, either.  People have been denied for stuff due to decisions made "way back when" to try to fool USCIS.
