I-130 Filers from China Document Translation (merged topics)

Hey guys! Hope I put this in the correct forum. I am back living in the states, but the past six years I have been living abroad, predominantly in China where I met my husband.

My husband is still in China working and we are starting to get some of our documents together for the next stage so there won't be any unnecessary delays. However, we realized a lot of our documents (rental agreement, residence registrations, police clearances, ring receipt, etc.) all need to be translated into English. Where did you go to get this done? Is there a company in China you recommend or did you have someone do it in the states? Google has been horribly unhelpful for obvious reasons (being blocked in China and all that) and using Baidu didn't turn up much either. 😥

For USCIS, anyone fluent in both languages can translate and certify the translation.  Make sure the floowing statement is attached to the translation:

 

Certification by Translator

I [typed name], certify that I am fluent (conversant) in the English and ___________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

What do you do about the formatting? I was told it has to look identical to the original document, including all of the seals and stuff.

It does not have to look identical.   It needs to be a correct translation.

 

Also the ring receipt and registrations aren't really needed for the I-130.   If you have been married together there are some simple evidences to include.   Documents taken to the interview do not need to be translated.

The registrations are the only proof we have that we lived together in China unfortunately. The rental agreement is only in my husband's name. Our lawyer was the one who told us it needs to be translated in the same format as the original. 🙁

Use your best evidences.  Good attorneys should know translators.  Tons of them online too.

I was on a Tourist visa and didn't qualify for DCF under the residence requirement. Our attorney said he knew one in America but that it was expensive and suggested we try to find a translator in China.

I googled "Chinese translator service near me" and found 20 services within 10 miles of my house. 

 

Can your husband translate?  

 

You could use your tourist visa and his lease as proof of staying together or the registration.   You don't need much evidence for a spousal.

My husband cannot translate because he is not Chinese. 😂

 

I'll keep that in mind about the proof of living together. The biggest concern I have is getting accurate translations from a company that others have used and trust.

He only has to read and write Chinese.    Or literally anyone that can read/write Chinese/English can do it.  (we had to get our HK marriage certificate translated into Spanish so my wife would get residency in Mexico . . . we used an online service for $25 and had it back within a day)

 

I think the only thing needed for the NVC will be the translated police report.

If you married in China, the only documents needing translation for the petition filing would be the Marriage Certificate.  Take your marriage book to the Notarial Office (Gong Zheng Chu) for official translation.  You can get the birth certificate translated at any time in the same way but it is not needed until the NVC stage.  Don't get the police report until after the petition is approved.  It needs Notarial translation as well.

 

I would skip including any rental agreements or receipts translated.  You don't need that evidence.  Your time in China with your spouse is documented sufficiently in your passport.

Yes just go to his local notary office 公證處 and let them know it will be used for an American visa purpose. 

1 Copy of marriage certificate and notarial translation is needed when submitting I-130

2 birth certificate and notarial translation is not needed until the NVC stage; if he doesn’t have his birth certificate,  I assumed he was born before 1996, this is normal, no worries, just go there and ask them what documents they need for a 出生公證

3 police certificate and notarial translation is not needed until NVC, he can contact his local police station or notary office directly because some offices have the authorization to check that.
