3 year tax returns I-864 question

Hey everyone. So we're working on the I-864 and I've got the previous years 2018 transcripts but Ive just realized I never filed 2017. Ive got all the numbers but can't submit until the IRS opens on Jan 27. Would it be a massive issue for marking No I haven't filed the last 3 years and explaining on the back that they will be filed once they open? Anyone had any issues like this? Also don't be dumb like me and file your taxes on time.

piggyback question, they say recent years taxes which I assume mean 2018 now, but when do 2019 taxes become the most recent year taxes, if that makes sense. Thank you all for your help

I'm not sure you have to wait to file 2017 back taxes.  January 27th is when the IRS begins accepting 2019 tax returns.  After April 15th, the most recent tax return will be for tax year 2019.

If you file the I-864 without having filed the 3 previous years of returns - and were required to file for those years - then the I-864 cannot be accepted. A promise to do so later is insufficient.

 

The 2019 taxes aren't required until after tax day.

Correct me if I'm wrong  but he/she can still file. What you need to do now is get a letter of verification of non filing from the IRS (you can get this from the IRS website), and attach your 2018 tax return transcripts. 

After this I would recommend for a joint sponsor as the fact that you didn't file your taxes for the 2 previous years could potentially show financial instability (or irresponsibility) to the CO  adjudicating your case which could get you either a RFE or a denial. Regardless of whether or not you've had your current job for the past 3 years I still recommend the joint sponsor as they can see that someone else has your back in case things go south.

There's a difference between not filing because you didn't meet the minimum requirements versus not filing because you forgot
