You can't enter the country with the intention of getting married. That is fraud. So they are right to remind you at the point of entry that if you intend getting married, don't. Obviously its different if you intend leaving the country (you'd probably point that out to them)

Not true.   They were not correct in telling the person the should not get married.  Non-immigrants enter the US, marry, and leave quite often.............It is fraud to enter the US via a non-immigrant visa/ESTA with the intent to stay and adjust status.

This man knows!  The law requires INTENT.  If your GF comes for a 3 month holiday and gets pregnant or even if you fall in love, of course you can get married and AOS.

 

Its even covered in all the USCIS manuals, and there are court cases to prove it.  The key is INTENT.  Don't show up with your papers in your suitcase.

 

I met my wife while she was on B2.  Dated for a few months, got married and AOS.  Went to the AOS interview with her and her daughter and was asked 3 questions.   

 

This forum is just super uptight about 'visa fraud' and even though its completely legal to marry and AOS they usually ban people who even think this.

 

I expect this post will result in another ban for me.  I dared to mention the thing that should not be mentioned lol

Actually you can get married and leave...you need to show you have enough ties to your home country and that you intend to return...of course the burden of prove is on you or else they will turn you back or even cancel your visa

Clarity helps to avoid confusing people..Your statement of "You can't enter the country with the intention of getting married." looked to me and others like a blanket statement ..the fact is that intent to marry inside the US is not fraud at all.....however, intent to stay and adjust after entering as a non-immigrant such as B2 or ESTA (married or not) is fraud.

Bit of a mouthful for the immigration officer though... he/she can't be expected to give a full run down of US immigration law, I imagine that's why the keep it simple.
