Yes.

Just be aware of the affidavit of support requirements when you get to the actual visa phase of the process. You can only count your own income that will continue from the same source upon returning to the US.

If your income won't continue from the same source, you will need to either use assets or find a co sponsor.

Also, be sure you are filing your tax returns. Reminder that USCs are required to report worldwide income.

 

What consulate? Some are more lax or strict than others. Some allow co sponsors and others may not. Some consider assets and others may not.

 

Domicile (or intent to establish it) may or may not be raised as an issue. usually it's not an issue for the K-1 as the I-134 itself does not have that requirement, but it has been raised as a concern by others.

 

Any particular reason you're looking at a K-1 instead of a CR-1 (spousal visa)? Generally when you live abroad with a SO (I'm assuming that's the case), a CR-1 makes much more sense.

In my case I'm the benefeciary, and now I'm working abroad,just to make sure if no conflict, if we start the process of the k1 visa.

The beneficairy working abroad is not an issue at all.

To be a little more specific, the I-129F petition was filed. Nothing with the actual K-1 visa has occurred yet. The key steps are:

1) USCIS processes the I-129F petition

2) NVC receives the case, assigns a cane number, and forwards it to the consulate

3) Consulate processing (specific steps vary by consulate, but includes a medical exam, filing a DS-160, gathering documents, the interview, etc.)
