Hi guys,

Wondering if anyone has done this yet. When I do the AOS for my K-1 visa wife she has a 15 yr old son on a K-2 visa. Do I have to file them both separate like two different cases and pay twice? Also if I do the AOS for my wife do I have to do one for her son right away also? Is there an age for working also? Should I get her son an EAD while I am getting my wife also? Any info on this would be greatly appreciated.

Just planning since I have so much time on my hands with all this waiting

You can file them together, but you do have to prepare seperate applications. Generally for most jobs, at least outside of agriculture. You need to be 16 to get a job. Its possible he may have his green card by the time he wants to get a part time job. So you could save yourself the cost for an EAD

I just went through this...you can put her son on the I129 and pay only one fee. But when you file for an Adjustment of Status in the US you will be required to file two seperate applications with two fees. the only other time fee may be combined is when you submit the Affidate of support. Both bills in one envelope with one $70 payment. There are many changes coming in the fee structure and even though the fees are going up some fees are eliminated. Check out the forum messages on the new fee structures.

You just went through adjustment of status? With an immigrant visa?

The USCIS does not charge a processing fee for the affidavit of support. Neither do the consulates in DCF cases. Only the NVC charges to process the affidavit of support
