After 2.5 months, it appears NBC is going to reuse my wife's biometrics for the N-400 as well. First movement on either of the two applications in a while.

Good that it's moving now.  I am thinking of applying for N400, did you apply online?

After 5 years of being together including 3 years of marriage I found out my husband have been cheating and now he wants to move out of our home. It has been a year since I applied for ROC and still no response apart from them sending my extension letter and that they are using my ols biometrics. Anyone have any idea if this entanglement can affect my ROC process. I was also in the progress of applying for my citizenship. Will I still be able to so?

Yes this does affect your ROC process. 

 

If you can reconcile and stay married together and the spouse supports your i751 petition by attending your interview if you have an interview then no effect on your case.

 

If you separate and you no longer are together as a married couple then you will have an issue with USCIS in the future. USCIS will suspect marriage fraud when they find out even if they approve you now without an interview.

 

If you separate from your spouse you should convert your case to a waiver case. The waiver is for the fact you are completing your case without being together with your spouse in a marital relationship anymore; devorce waiver, abuse waiver or extreme emotional abuse waiver.

 

When you file for naturalization your marital relationship will be scrutinized if you file under the three year rule. You can only get naturalized if you have been married to a USA spouse for the full three years before you apply. 

 

If you are no longer together with your spouse and you have a green card for 5 years total you can file for naturalization. While being married to a USA citizen is no longer required USCIS will likely look at the circumstances of how you got your green card (when you were approved versus when you broke up) and see if there are any signs of marriage fraud. If you are still married but not together I guess you would be okay.

Thank you for responding. We are still married and we have tons of proof that our marriage was solid. We own three cars and a house together, credit cards, life and car insurance. The paper trail is heavy to get through it all incase they want to investigate. My husband did tell me that he will do everything that needs to be done to get my paper works completed. Hopefully he means it. In my state we have to be separated for a year before divorce, so I'm willing to take the chance to apply for my citizenship. He is still living in the house but I know he will be moving at some point.

If you no longer live together and are separated in your marriage I would not file for naturalization until you reach the five year mark. If you and your spouse live together and are still officially married you may get away with filing under the 3 year rule.

 

Also if you are called to an interview and you are not together with your spouse I would convert to a devorce waiver case at the interview.

 

If USCIS finds out that you are making misrepresentations about your marriage then you are putting your green card and your citizenship at risk. You are responsible to keep USCIS up to date on your marital status so not telling them about your real marital status is risky. Remember USCIS investigates you and your spouses background if they see data that conflicts with your evidence you submitted like different addresses you will trigger redflags.

We received our invitation to interview in late feb for April 1 and then my mom got COVID and not only was she our babysitter for our 7:45am appointment but we had direct contact with her. To be honest it was really hard to do the right thing and not attend because we have been jerked around so much by uscis a huge part of me really wanted to say F it and just go. but we called and rescheduled and now it's may and we still haven't heard anything. any idea how long a "reschedule due to covid" might take :(  i'm so sad.

I've heard in some cases they call the morning of to inform that it'll be a combo interview. No such courtesy call in many other cases. Good to go both just in case. Congrats btw!
