Hello all! With all that is currently happening in the US, my fiance and I have started discussing him applying for selective services when he is in the US. I know that you have to apply if you are under 26 and waiting on your AOS after marriage. My question is, we are planning to get married on 10/10 (if possible). His birthday is 10/29 and he will be 26. Since his birthday would be within the 30 day period after our wedding, could he get by without applying?

 

This is really more of a hypothetical question. He will obviously sign up if need be. I am just curious if any bad consequences would come if he didn't given our time frame.

I don't see that he qualifies on the "Who must Register " list.  He would be exempt due to entering on a nonimmigrant Visa.  

 

As an aside,  your marriage date has nothing to do with any 30 day clock as the clock starts upon entry but he would still be exempt

I know the K1 visa is nonimmigrant but once we are married, the K1 is null and he will be living in the US based on pending AOS. I thought that the marriage date would be the day that he is no longer on the K1.

You are confusing different things 

 

The k1 visa as an entry document is null upon entry,  this is not to be confused with his entry status granted at the POE,  which is for 90 days as indicated on the i94 issued by the CBP.  Marriage doesn't change the entry status granted 

 

His k1 entry status will be "adjusted" to resident upon receiving his green card

Oh, I see. Thank you for clarifying! So if he turns 26 before his I94 expires, he won't have to register?

September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
