Out of interest, does anyone know how this is going to work? I mean, I've seen the PDF listing the fees, and it makes no mention of this, and does in fact list AOS filing fees as costing more and makes no mention of "free" AP and EAD.

Presumably they'll have to change the forms or at least the website with new instructions? I foresee a lot of confusion.

It was at the bottom of the PDF.

And yes they are going to have to revise the forms. It really is not that big deal. The I-765, I-131 already require that a AOS or other process is in place. It is just a matter of qualifying if payment is needed. With the new fee rule, they have to revise all of the forms regardless.

Besides, we already get a grip of people who do not read the guides anyway, so there are going to asking all of those questions on the boards.

I've wondered about the clerical process also. Unlike IMBRA (wherein the I-129F required modification due to a change in the law) this form change will be due to a change in internal USCIS fee policy. So (hopefully) it won't be so tough for them to get the petition updated and online in time.

Yes, I just did see it at the bottom of the list. Nice, small print. lol Well, that's a good deal I guess.

They do say they will speed up processing times with the fee increase.

How do you figure its nothing for nothing? :blink:EAD is like car or house insurance....there when you need it. If your AOS winds up in namecheck for months or possibly a couple years, you will be wishing you HAD work authorisation. I'm glad we filed EAD...our AOS took 9 months to be approved...a far cry from the speed of which you indicate. No one can tell anyone else on here exactly how long it will take to be approved for AOS.

So the new fees include advance parole and employment authorization too? I didn't know that. We were thinking of getting married a week or two before the fees increase. I would think as long as the postage date for your application is before July 30th you would be under the old fees. Wouldn't you?

Yes, it includes the EAD and the AP and from what I understand they are automatically renewed if necessary until the green card is approved. Someone correct me if I am wrong?

Another thing to look at is this: the K1 is a totally different leg of this journey. Totally different application. The AOS is a totally different application. Maybe one day they'll have a K1 Total Package Deal...K1 through Green Card approval for one price. ;)

Because it happens from time to time does not make it a rule

Definitely not a Rule. But at this time and the last couple months it's happening unless there is a RFE involved.

Things can change tho depending what the man wants to set priorities on.

Lots getting their GCs in 2 to 3 months.

Recently it's been the AOS , CRs and IRs

CR1's and IR1's don't file for AOS.

And if you are thinking the visa type has something to do with how fast one gets a greencard - that's incorrect.

The speed with which your greencard is approved has to do with several things beyond an RFE. Such as whether or not the petition remains at the petitioner's District Office or whether it is transferred to California Service Center; whether or not that service center is backlogged or not; and most importantly whether or not you become the victim of a stalled security clearance.

Operating under the assumption that your card is going to arrive in 2 to 3 months is highly optimistic.

And yes - the new fee does include Employment Authorization and Advance Parole that DO NOT EXPIRE in addition to the biometrics fee.

Sorry I guess I wasn't that clear.

USCIS is concentrating on processing AOS AND CRs and IRs faster at this time !

Correct! Should have said it takes 2 weeks to get into USCIS SAVE data base so SSA can get into it!

Really doesn't make much difference tho! TWO weeks is TWO weeks no matter what you call it!

EXcuse me , but its not a requirement to file form I-485 AOS to file I-765 EAD or AP I -131 Appears more people than you realize dont read the guides. Maybe you miss something occassionally. Just making a correction and suggesting tolerance and understanding and patience for everybody, after all not everybody on here are experts or why are we here?

There is no flame war going on here, just simple corrections.

Here it is from the USCIS Website:

Who is Eligible?

* The specific categories that require an Employment Authorization Document include (but are not limited to) asylees and asylum seekers; refugees; students seeking particular types of employment; applicants to adjust to permanent residence status; people in or applying for temporary protected status; fiancés of American citizens; and dependents of foreign government officials. Please see Form I-765 (Application for Employment Authorization) for a complete list of the categories of people who must apply for an Employment Authorization Document to be able to work in the United States.

as I stated earlier you must be in AOS or other process.

These are 'interim' benefits which mean that there must be another process going on in order to be eligible

Please dont mis-understand me, im not nit-picking or trying to start an argument, just trying to be helpful with information as i understand it. If im wrong i stand corrected. After all, i have been chastized on this site for imperfect typing. Really helpful for me.
