What the hell is this and why should those of us who applied for a visa before have to pay so much? My process has been going for a while now. I should not have to pay a thousand bucks for adjustment of status when I should have been over there by now. I say bs!

I HATE miles, gallons, pints, words spelled without u's, and all that other jazz...

02/25 Received Welcome letter in mail

02/28 Green card arrived in mail. Done with USCIS for now

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

I am just curious as now my beautiful baby has arrived, if we get married now, and submit our paperwork to apply for AOS, when can I still pay the $395 and not the $1095, if I can still make the deadline I would like to for sure. I was reading all these posts on this a few weeks ago and was having trouble sorting out when I would have to start paying more for the AOS for the K-1 visa.

We have not yet married or applied for SS# as she got here 3 days ago. Also I read that you have to wait 2 weeks to get a SS# or to apply for one, is this the correct # of weeks to wait?

Sometimes takes 2 weeks to get in the SSA data base. No set time tho and doesn't cost or hurt to try.

Getting married ASAP is more important as no need SSN to apply for AOS.

Apply for AOS ASAP also even if you don't have all the documents. You'll save big bucks and only maybe have to deal with a RFE. Worst they can do is send it all back!

Total new fee for AOS "reads" $1010.

So the new fees include advance parole and employment authorization too? I didn't know that. We were thinking of getting married a week or two before the fees increase. I would think as long as the postage date for your application is before July 30th you would be under the old fees. Wouldn't you?

Timeline

The new fees cover all the other fees that were invented as stop-gap processes. People complained that it seemed like USCIS was slowing down purposely to collect these other step fees that were only created because GCs weren't coming fast enough.

The gamble is - not everyone would want, need, or apply for those other steps, but now, you'll be paying to cover them anyway. It's a double-edge sword, in a way.

I urge everyone to read the USCIS fee increase proposal document, it really does answer a lot of questions. You may still disagree with their reasons, but you'll know what they are and you'll know what the new fees cover.

Good advice. However, I looked at the USCIS site and I didn't see anything about the AP and EAD being covered under the thousand bucks. Instead I saw the AoS is 1,010 dollars; AP is over 300 bucks and the EAD is over 300 bucks.

Yes, it does seem to ebb and flow here on VJ, but we are just a small part of the Family Based Immigration demographic. There is no way of knowing that you petition is going to be approved. Due to feedback to USCIS and growing concerns that they were stalling applications, they decided and were approved to roll all the fees into one.

This is why most people who have been here for awhile would never recommend that you not file for interim benefits, it is a safety net. If your spouse is comfortable not working and not having the ability to travel out of the country, then yes. There is no way to define the term in which any particular petition will be adjudicated.

CR1's and IR1's don't file for AOS.

And if you are thinking the visa type has something to do with how fast one gets a greencard - that's incorrect.

The speed with which your greencard is approved has to do with several things beyond an RFE. Such as whether or not the petition remains at the petitioner's District Office or whether it is transferred to California Service Center; whether or not that service center is backlogged or not; and most importantly whether or not you become the victim of a stalled security clearance.

Operating under the assumption that your card is going to arrive in 2 to 3 months is highly optimistic.

And yes - the new fee does include Employment Authorization and Advance Parole that DO NOT EXPIRE in addition to the biometrics fee.
