Expired Fiance Visa after 2 year of applying!!

Hi All,

 

can any one please tell me ih he has gone through this? my status was under AP for almost a year and 8 months and now all the sudden they are saying that my visa is expired due to whatever they are saying without them even noticing us or anything. i emailed them so many times but they never answer me and use the senates and i am in the process of the Mandamus. like really this is a denial!!! :(

what other details, the interview was on April 2018, the counselor liked out story and told my fiance that everything is fine but we need to give you the ds-5535 and we filled it and send it to them and every time we email them, they tell us to wait for background check

That's the hard part about a fiance(e) visa.  The petition has a limited shelf time.

 

It would probably be best to get married and pursue a CR1 visa

First thing is to make sure the case was really expired and denied. Some of these processes are automatic. I have seen cases marked as Expired that were subsequently returned to AP after getting in touch with the consulate.

Timelines:

ROC:

7/27/20: Sent forms to Dallas lockbox, 7/30/20: Received by USCIS, 8/10 NOA1 electronic notification received, 8/1/ NOA1 hard copy received

9/25/17: sent forms to Chicago, 9/27/17: received by USCIS, 10/4/17: NOA1 electronic notification received, 10/10/17: NOA1 hard copy received. Social Security card being issued in married name (3rd attempt!)

10/14/17: Biometrics appointment notice received, 10/25/17: Biometrics

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

K-1:

K-1

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

You didn't mention that you provided the info, only that you received the DS-5535 and you emailed them numerous times.

 

Have you emailed since it says expired?

it just got expired today. i emailed the form only once after the interview bc they asked us for it. my lawyer just did, i will see what will happen!!

No I'm a female from a low fraud country but if you look at the AP forum it's very common for K1 from high fraud countriea.

Am sorry, but from all indication your K1 is dead... I know its hard to swallow expecially after 2 years of waiting.. But as far as love is involved we have to keep up the fight. It's time to get married and file for CR1.. It might not be as fast as K1... And you also need to understand that k1 process from high fraud countries or some middle east countries take significantly longer as yours took 2 years.... There is not a lot of bases for denying CR1 as far as the marriage is legit.... So please don't give up... Wipe your tears be strong for one another and move on to the next step and fight for it.. Goodluck

Thanks for your positive message!! Some people I know they received their fiancé visa in less than a year and they’re from Middle East

Thats cool then, you have a choice of K1 again or CR1 but personally I would advice the K1 route ....either ways you choose to go about it, I wish you guys the best of luck

CR1 you can keep fighting if it's sent back or denied etc... an approved I-130 never expires. You dont have to keep refiling.
