Hi everyone and happy new year!

 

If we have the last three years' tax transcripts and the last three months' payslips, would that do for proof of income, to accompany the affidavit of support when AOSing?

 

Basically, we have everything ready to go - only thing we don't have is the employer letter and unfortunately, my husband's HR department don't do anything quickly, particularly when they're just back after the Christmas break...

What are you inputting as your income in Part 6 Qu 7?

1. Your 2018 reported tax income?

Or

2. Your current income?

 

If 2. You'll need SIX months (not 3) of current paystubs OR a current Employment Verification Letter stating your projected annual income on it.

 

I always suggest BOTH 1. AND 2. as they back each other up BUT the instructions state (which hopefully you have read) you can provide 1. OR 2 IF you are reporting current income.

 

IF you are reporting your 2018 reported tax income in Part 6 Qu 7,  you dont need either 1. OR 2. Just the MOST recent Tax Transcript.

 

You also need the Return Tax Transcript to satisfy Part 6 Qu 23 as input in Qu 24a - 24c. Only most recent year is required. Three years is OPTIONAL.

Zoe, the instructions say employer letter is optional. 

But if relying on the 2018 tax return (transcript) as your main proof, it is best to take the reported number on Form1040 line 6 and use that as the current income stated on on the I-864 (page 4, Part 6 #7). If he got a raise since 2018 and you want to report a higher current income, it would be better to have that clearly stated in an employer letter and 6 months of pay stubs. 

 

If the tax return income is enough to sponsor, then making a bit more now doesn't really do that much for you. You won't get more approved with 900 extra quid.

Fab, thank you both!

 

He's used the reported number on his 2018 tax transcript and that's higher than the amount needed to sponsor, so I've told him not to worry about the HR letter and to get the package in the post today. His income actually fluctuates quite a bit, depending on how well the video game he's worked on sells - but all three transcripts (2016, 2017 and 2018) show a six figure income, so well over the required amount (I'm his only dependent).

 

@Wuozopo - in case you wondered, we decided to do the paperwork side of the marriage when I arrived and then still have the big wedding on 7th February - not being able to drive is doing my head in, so wanted to get the ball rolling in terms of AOSing!

I can’t imagine not driving. No way! so I just drove on my UK license. Got stopped twice too😩 but never again in the 11 years since.
