Green card fraud

So my stepchildren have green cards.  They come here every 6 months and stay for like maybe a week and go back to Dominican Republic. So here’s the thing when my husbands kids are here , he treats me very different and actually stays in hotel with his kids . Also the reason his kids haven’t moved here yet is because his daughter is going to college to be a doctor in her country . My question is they have not established residency here in the United states and I believe my husband is planning once his daughter finishes school for her to come here than his daughter will file for his ex wife to come over here . In the mean time is there anything I can do since they basically are not living here in the US. I know the last time they came for visit they were questioned why they don’t stay long when they come . I just don’t want to be taken advantage of , which it seems I have been used Any help would be appreciated . Thank you

Well there is nothing that you can do, they may well be facing an Immigration Judge is the continue to use their GC to visit rather than live in the US. But going to school may well work.

 

The more common route we see is for the immigrant to divorce and remarry, waiting for the child to naturalise and then sponsor the Mother is certainly one option but that will take a long time.

Their Green Cards are probably living on borrowed time.......especially since they have already been questioned.  This will not end well for his plan.  "Tales of the Green Card"

If they keep up with that behavior then they may have their permanent residency be deemed abandoned.

Nothing for you to do there...that's a decision CBP makes at every entry. They can see their history and make a judgement call.

 

Only thing for you to do is divorce and move on.

If you really want - and he only has a 2 year green card - you can submit evidence that he does not live with you. USCIS may or may not look at it. That may address if he tries to lie about his residence for ROC to get the 10 year green card. But he can remove conditions without you, and he has no obligation to live with you. He would just need to show that he entered the marriage in good faith.

 

If he already has a 10 year green card, then there is nothing at all to do but move on.

 

He will be unable to petition for another spouse until he has been an LPR for 5+ years.

That's what I got from it, too. I was just pointing out that if he was somebody who committed fraud, lying about his residence if he thinks it would help would not be very far-fetched (although USCIS does tend to want to see that sort of evidence anyway).

 

Although, I just checked the OP's timeline - ROC was completed and approved already. So that boat is long gone. Only issue is if he keeps up the travel abroad.

Well plenty of children have gone back to finish their education, getting qualified as a Doctor and not being US qualified if your intent is to finally move here seems odd.

I assumed from the wording of the original post that the children are the ones who travel back and forth (from prior threads looks like one is roughly 19, and other is 11 or so), and that the husband mainly resides in the US.

Maybe, jus maybe it’s not fraud or ill intention related.. 

 

Is your family home suitsbile for the additional guests? Do the children know of you/like you? Is the ex-wife pressuring the children to not stay with you during their visits and your husband mearly accomodating her?  Or is he just keen to have quality one on one with them for the duration of their stay, after all a week every six months isn’t much time together... So many variables when looking at maturer children within family merger.. 

 

the childrens green card and potential loss of if really really isn’t your concern if you yourself have minimal contact with the children and they’re more than permitted to file for their mother down the track if they qualify.. I wouldn’t worry about that part.

 

maybe sit down with hubby, ask him why they don’t stay with you during visits etc.. if it then seems off, seek marriage guidance or divorce,

^^I'll be honest this was one of my first thoughts too, coming from a broken home myself in my late teens, where one parent has remarried.  Adding to the burn, he married his long-time mistress which made the family situation even more resentful when whenever we kids came in contact with "the other woman".  

 

There is also the possibility that their mother has poisoned their minds against you as the new step-mom, or guilt-tripped them enough where they feel it's wrong somehow to actually learn to like you/begin to accept you as part of their family unit....so the father is trying to keep the peace.

 

On the flip side, I can understand the OP being a bit peeved about the hotel arrangements when the children do come, because it doesn't give her any ability to build a closer relationship with them.

 

Green card/residency issues aside, of course.

As others have said, there's not much the OP can do related to green card fraud.

 

She might want to consider doing sort of the opposite, i.e. encouraging her husband and step daughter to gain citizenship as soon as possible and then she's off the hook for the support she signed up for in her affidavit of support. Then divorce the guy and wash her hands of this messy family.

@debbiericardo It's time for you both to sit down and have a conversation. Maybe have your best friend/relative beside you when talking to him.

Sometimes marriages just don't work the way we want them to. You have shown courage by reaching out to this community and I know you will be able to decide your future by talking to him.

It sounds like their use (abuse) of their green card as a tourist visa will come and bite them in their butt one day soon. IMO they should lose their LPR status since they don’t reside in the US- but that’s not up to me or you to decide. Was the plan always for them to spend as little time possible in the US or did they leave once they were issued their green card ? 
if you think your husband is using you then you need to sit down and talk with him, attend individual and couples therapy and or think of filing for divorce.
