Timeline

Hello! My husband has tax returns for 2018 and 2017. He did not work in 2016 as he was a student and he only worked for half a year in 2017. He worked in 2019 but my k1 will expire and I will need to file for adjustment of status before the 2019 w2 and tax returns/1040 arrive. Will it be an issue that he can only show income for 2018 and half of 2017? We aren't sure what to do because the aos form says 3 years.

He needs to prove current income to be able to sponsor you. 

 

If he didn't file taxes any of the last 3 years, he will just have to explain why didn't do it.

you can request from IRS Verification of Non-filing Letter for the 2016

AOS/EAD/AP ->: 11/29/18 - NOA1: 12/04/18

Biometric NOA:  12/14/18  Biometric Appt: 12/26/18

Case is Ready to Be Scheduled for An Interview: 1/16/19

EAD/AP approval: 3/18/19

AOS Interview Appt: 6/4/19

AOS Interview: 7/10/19

AOS Approved: 7/23/19

GREEN CARD IN HAND: 7/26/19
