Received RFE for form I-864. Could someone try to help with how to handle it? Thanks.

 

I provided my pay stub for the past 6 months which is way more than enough to meet the poverty guideline, not sure why they still saying that I don't meet the requirement.

Were paystubs the only evidence you included? No tax transcripts?

 

Also, let's please reserve the word "urgent" for real urgencies. Your issue is not urgent; it's not a matter of life or death and no one is being deported.

was your 6 month income > 125% of poverty wage  or was the 6 month income > 62.5% of poverty wage ?

I also submitted my 1040 tax return forms for the latest year and my W-2, but not form 1099 of my state tax return. 

 

My annual income is 3 - 4 times of the 125% of poverty wage, I though I only need to provide the payment stub for the passed 6 months. So I only provide payment stub of 6 months. But my income of that 6 months is > 125% of poverty wage.

It’s because you didn’t submit the 1099 form. The instructions says if you submit 1040 then you also have to submit the W2 and 1099:

 

”If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.”

The I-864 was deficient due to improper documentation. As such, the current income that can be counted for sponsorship is $0. $0 is below the minimum requirements.

Provide a full packet with all supporting documentation and the income can be counted.

Am I understanding this correctly that if one submits the 1040, they must also submit the W2, 1099, and schedule but if one is submitting the tax return transcript from IRS, there's no need to submit to the 1040, W2, 1099, and schedule? I thought all of them was still required + transcript

Yes, if you submit tax transcripts then you only need to submit the W2 if you filed your taxes married filing jointly. But if you submit the 1040, then you need to submit the W2 and 1099. It's all in the I-864 instructions.

I think the instructions say W2 AND 1099 IF tax transcripts and joint filing.. right?
