Hey all,

 

I have a couple questions about the AOS process I'm hoping someone can help me with. My spouse is filing the i-485 with an already approved I-130.

 

1.  The checklist on the this site says you need to send a certified copy of your marriage license but on USCIS's site it doesn't say that. Also, on the I-485 instructions it says "If you are filing Form I-485 as the derivative applicant spouse of the principal applicant, you generally must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place." This says to me that only derivatives need it and even then only a photocopy, not certified.

 

2. Should I have received a USCIS online account number together with the I-130 approval or are those totally separate things?

Follow the official instructions: https://www.uscis.gov/system/files_force/files/form/i-485instr.pdf Thus, marriage certificate is not needed.

They are separate things.

I thought from your other thread that she was currently awaiting the interview in Montreal and was planning for only a 2-week visit to see your family?
