Hey there,

Brand new to this website. My wife is from Venezuela and I'm a USC. Her and her two children now age 11 and 13 came 4 plus years ago and filed for asylum a little after there were here.

We met and dated for 3 years then we married 4 months ago. Her and the children's asylum case has been pending. I understand that we may use forms I-130 and I-485. Just not sure which ones for her children and basically need some advice so that we file the correct paperwork. We would like the option to travel outside the US as well. And I understand that it is less expensive to do it before her older child turns 14.

Thanks for Any help in advance!

From a practical point of view does she have a current passport and where does she want to go, could she get a visa?

Passport not current. There is no way to renew since Venezuela is in turmoil. Just thinking we would like to go to Aruba during this process

awaiting approval of status.

Well she needs a valid passport and a visa.

She could request a prorroga from SAIME, it's a 2 year extension for her passport http://tramites.saime.gob.ve/. She needs a valid passport to travel, and as far I know she will also need a visa, AP or green card to travel outside the country.

As far as I concerned if you want to apply for your wife and her kids what they need to do first is to close asylum case. You cannon apply for them if asylum case is pending. Some of my friends were in the same situation and they even used a lawyer for that cause it's more complicated than AOS and it took a year or so just to close the case.

But I'm not a lawyer, what I'm telling is it can be not easy.
