Question about traveling while removal of condition pending and green card is expired?

Hello,

 

My husband's temporary green card expires in May 2021 and we were wanting to travel to his home country (England) at the end of that month for a couple of weeks to visit with family. Are there any rules against traveling when your green card has expired if you have a pending case for a permanent green card and are able to show the receipt when traveling? Feel free to send me any links to legitimate websites on the subject. If it isn't safe for him to travel we can always push it back it'll just be longer we have to go without seeing his side of the family. We don't want to take any chances for him to be denied entry back into the country. Btw, I know this is a long time away and some of you reading this are probably wondering why we don't just go before May. Well we actually just got back from spending Christmas with them and we want to try to go ahead and plan ahead for a trip next year. :)

You can re-enter the US with an expired conditional Green card IF YOU ALSO PROVIDE THE 18 MONTH EXTENSION LETTER you will receive after filing the I-751 for Removal of Conditions.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Just make sure to apply 90 days before or as close to the the 90 days before so you have time to get the extension letter. It clearly states on that, that it is also for travel and work. Show that and the expired GC and he will be fine. We had no issues at all going home last summer on those.
