Hi, I am 26 years old and a Canadian citizen. I am applying for a k1 visa again with another woman from the US. My last fiancé and I broke up in Jan of 2019 and I met my current girlfriend in Feb of 2019. None of us went through the process of formally cancelling the petition. It was received by the US embassy in Ottawa in April of 2019 and I believed from the letter follow up had a window of Aug 2019. The visa wasn’t denied or approved as I did not go to the formal consulate interview. Question if I was to be a beneficiary again of a K1 visa application in Jan or Feb of this year would I have any issues?

The biggest problem will be when you show up in Ottawa.

Google K1 withdrawal letter and mail it to the consulate.  You need to kill the first K1 otherwise it can sit for up to a year (or more) in limbo.  My k1 was at the consulate and I emailed them a copy of the letter (back in November 2019) and just TODAY I got a notice the DoS got the the I-129F (not USCIS) on Jan 3.  So in another month(?) it might make its way back to USCIS.

 

If I didn't withdraw the I-129F, the consulate may have automatically renewed it for another 4 months (I-129F approvals last 4 months and can be renewed).

 

So get the letter in the mail.. you'll have at least 3 months until the first K-1 is formally withdrawn.

The beneficiary cannot withdraw an i129f only the petitionner can

Yes. 

 

 when they GOOGLE K1 WITHDRAWAL LETTER this will become clear.
