PRESIDENTIAL PROCLAMATION ON HEALTH CARE: On October 4, 2019, the President issued Presidential Proclamation 9945 on the "Suspension of Entry of Immigrants Who Will Financially Burden the United States Healthcare System." For the most up to date information on how PP 9945 might affect your case, please visit https://travel.state.gov/healthcare.

 

Can anyone tell me what is all about? I don't understand whats this means.

but isnt the public charge rule already in the immigration act passed by congress .what is the court trying to stop? the law that was passed by congress.

The court has blocked DHS from implementing and enforcing the rule so the rule is not in effect right now

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

The public charge rule remains fully in effect as it has for years.

This particular proclamation requiring showing evidence that you will obtain healthcare insurance within 30 days of entry on an immigrant visa is blocked by the court.

DOS* This proclamation covers visas.

There is a separate public charge rule change (not a proclamation) that was set by DHS, which is also blocked.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Unless the court orders otherwise, it will apply to all visa applicants subject to the proclamation. When somebody filed the I-130 is not relevant (unless the court orders otherwise), although DOS or the individual consulates can have a separate timeline for actually implementing policies to comply with the proclamation. For instance, if the stay were lifted today, it would be unlikely for them to be able to start implementing it tomorrow IMO...it can take some time.
