Hi guys. I got hired and making around $41K as an annual salary. It's a new change of situation for me after I have been going on about my landlord self-employed not meeting the minimum requirement for which I had to add retirement benefits of my household parents. Really excited about this as I started looking for work around a month an a half ago so I feel like there was a chance I will be rejected, so this new job is right on time....or so I thought, because after I started researching, I realized that having a new job doesn't show stability and that's still no guarantee! I feel like I'm in no win-win situation from every angle and I can't find a joint sponsor, so I was hoping my own situation would help, but I see that even in this situation, because I'm new to this job, I might still be screwed...well my hubby but me too obviously! 

 

The problem is that we already submitted our I-864 and 864As and it was accepted but I was warned to get a joint sponsor, so I can't re-submit a new I-864 to override the old one, plus I would have truble calculating my half a months' income (started mid-November), plus my full month's income as my 'current annual income'. What can I do at this point? My employer wrote me an employment verification letter, and this I have submitted as employment to NVC while I still have the chance. Is this enough or what else should I do to prove employment? What I did was updated my LinkedIn profile with my new employment, printed the home page of my new work website, and attached to those two, I added my employer's verification letter. Did I even need to show the NVC the company's website home page? I wasn't sure how to proceed, hence that move. Has anyone not had their new employment been counted just because it doesn't show stability? 

 

Another hypothetical question....I am waiting for my large settlement from a past accident I had but it's going to take around couple of months. Once deposited, I will have a large $$ in terms of cash assets, if my husband is denied, for example, and is asked to get a joint sponsor, and we won't have one, can I just show the bank cash asset after I deposit the settlement check? Even if divided into 1/3, it's still large combined with my already existing cash.

Is it half a month, or two weeks?  Take the gross for any full pay period times the number of pay periods in a full year.  That's your "current income".  Document it with ONE, full pay period pay stub and use the employer letter as a back-up.

 

Don't know why you can't take a new affidavit of support to the interview with the appropriate supporting documents.  Put a letter with it asking for it to replace the previously submitted financial package.

Facts are cheap...knowing how to use them is precious...

take a new 864 to the interview with the paystubs you have and a letter from your employer stating your approximate annual salary.

 

not a big deal.

 

My financial situation changed after we submitted our AOS and I simply took a new 864. Officer didnt even glance at it.

Thanks for the reply and sorry for the delayed response...i was in the middle of my finals and didn't get a chance to reply until now. To answer your question about my pay duration for my new job...it is half a month/bi-monthly. I started mid November and already got 2 paychecks each with gross $1,720 earning bi-weekly (net $1,325 per paycheck/stub). I have still one paycheck to receive for the remaining of the year to make it 3 paystubs/checks total. That would be $5,160 gross and $3,975 net from mid-November to end of December. From your above message, it shows me that I need to use the gross amount and multiply it with 3. 

 

Since my self-employed landlord status slightly changed where I have a gross annual salary of $41K+ now, and I need to slightly redo my AoS,  my husband will have his interview most likely in February 2020, so my question is whether 2020 earnings up until his interview (whenever that would take place) should be calculated into my new AoS (meaning should I wait until last minute to redo Aos to know how much to include of my earnings) or is this strictly 2019 earnings still that I am doing even if now submitting this in the year 2020? Again, correct me if I misunderstood your above message, but it seems like you are saying that I should only count 2019 earnings/paystubs. Does this mean that I should not keep my 2020 pay stubs I get up until whenever his interview will be and no need to show those if I am not including my 2020 paystubs into my new AoS? Could you please clarify this just want to make sure that I understood you correctly as I finally have free time to sit and re-do this AoS one more time this week. Your salary is $1,720 X 24 = $41,280.  How much you've made this year is not part of the calculation.  Your salary is your salary, period.  That's your current employment income.  Your total current income is your salary plus the total income from line 6 of your 2018 tax return.  If you file 2019 taxes before the interview, update your affidavit of support to reflect your salary plus your business income.  In other words, your salary plus line 6 of 2019 minus your employment income for 2019.

Thank you! We are due for an interview before April, so a new tax return wouldn't be present at that time yet. My new AoS now has Part 6 of the following: Employment, I put down new employer info/my position ($41,300), then below that I checked the self-employment box (as before) as a landlord ($11,428); and in 'my current income' section, I put down $52,728 by totaling both. If you remember, I had added both parents SS incomes before, but now that I am above the minimum, I excluded both parents as household members. Should I put them right back to be on the safe side since my employment is fairly new?

 

Also, because my husband will be attending his interview alone, I put together a cover letter reflecting my overall financial situation where I did present evidences of several things for the "overall picture" 1) Of my $600,000 free and clear of mortgage large townhouse by stating that although it is not used as an asset on my I-864, I still want to show that my husband will be provided with housing without a mortgage just to show that I am not burdened by housing costs myself.; 2) I have several degrees and certificates, so I also mentioned that to show the CO that I have graduated from a reputable university and have other certificates that makes me competitive in the job market. Lastly, at the end I did explain briefly that the reason of my low tax return incomes from the past few years because of my landlord self-employment status were for my paralegal studies program and that it also gave me the flexibility with my time to travel overseas every 6 months to see my husband, which would not have been much possible had I been fully employed somewhere. I wanted to explain that it wasn't because i'm lazy or can't find a job, but that at that time for school and to be able to see my husband often, being a landlord helped time-wise although the income was low.

 

I did at the end mention that if needed, I can add my checking account balance (I have around $25,000) as a supplemental asset and that I have the option to add either or both parent's incomes as household members too, although I didn't mention the exact amounts as I am doing it here for you to see, so that the CO will be aware that I have backup in form of household member/s. I heard that the CO might not look favorably that there's a tenant in my household upon the relocation of my husband, so I mentioned that when my husband's visa is approved, I will not continue the month-to-month leasing agreement/tenancy. I was going to stop the tenancy anyways when my husband moves, so I wanted the CO to be aware that this isn't an ongoing thing after his move. I only want to know what do you think of my cover letter explanations and whether I should omit something that I mentioned above that might not sound right with the CO. This is my very last chance to do this right lol.

Hi guys, my mom's friend just offered to sponsor my husband out of blue as I didn't think we will have one, so im so happy that there is light at the end of the tunnel for me. I wanted to ask a few questions about joint sponsorship please just to make sure that im on the right track. My mom's friend is a part-time instructor at college (she works 7 months only) and she just sent me a copy of her latest pay-stub where it shows the following regarding her income:

 

Semi-monthly pay; Part-time. I am assuming that as long as she is making enough, then her part-time status won't matter much right?

YTD gross shows as $26,393.14; which includes "employee contribution of $2,019.07" to make it that gross YTD income of $26,393.14. I am wondering what this is and whether on AoS I should just write $26,393.14 without worrying that she is contributing $2k to her salary?

She is also retired and earns SS benefit of $11,400, so employment and SS added together she has an annual gross $37,793 individual income to sponsor my husband.

Also, on AoS, are we required to put down all the 3 tax return incomes of the last 3 years in each box or we only require to fill out for all last three returns if I have chosen the box to submit all 3 years of tax transcripts? I am talking about I-864 page 5  questions 23.b-24.c?

 

 Also, how many pay stubs should I get from her? I don't want to bombard her too much about it so will a few work or I should bombard her nonetheless? Her pay-stub shows all info about her (name, address, social #, college address, direct deposit bank name, so am I required to have her get an employee verification letter?

Personally I would send her the I-864 and instructions to fill out.  You can do it for her but she needs to sign it anyhow. You need her most recent tax return transcript as well. 

Her pay stub should mention either her yearly salary or her pay per hour for her gross pay (not net).

Hi there...I got a joint sponsor! After so much stress, I got one so im so thankful to the universe for shedding some light for me at the end of the tunnel! I prepared the new I-864 to add to my old one now. The lady who is helping me currently works and received SS retirement benefits too. For 2019 salary, she gave me her paystub where it says YTD $26,393.14 (works part-time) + $12,000 SS benefits income. All I need to do is take her gross SS benefits and add it to that YTD $26,393.14 salary to give me her 'current annual income' right? I think I have this figured out with your previous help. She also has a side business, but I am not sure at this point how much she will put down as earning for 2019 taxes since it's coming up, she doesn't seem to put down much for her business earning based on her few tax returns in the past...it was like $475 on her last tax return on one of her business Schedules. She'll have around $38,200 of annual income, so I hope it's good for sponsoring my husband as 'household of 2' which is by poverty guideline minimum of $21,137. Just wanted to confirm that on her paystub YTD is her annual income right? i had to look up what YTD was so wanted to quickly confirm that's what it means...her gross annual income.

Thanks. I will do that. I was wondering how should I best proceed now? The NVC had accepted my old AoS but I freaked out as in the feedback section they said that I should find a joint sponsor for not meeting the minimum requirement (even though i add household members and we were above $7K for household of 4) and NVC accepted everything (even that AoS docs), but requested my divorce decree. From the 1st time I submitted the docs to NVC, it took 3 weks to review and accept, but now for just one RFE doc the divorce decree, been waiting for more than a month in addition to those 3 weeks. I was wondering whether I should just use this waiting opportunity to add this new joint sponsor AoS at NVC level again as new AoS, so that they will send it to the consulate with everything else or should I let my husband take it with him to the interview whenever that will be while NVC sends the AoS they made a comment on regarding the household one I submitted? Could the hold up be because of the joint sponsor notification to me, although I don't think so cause they would have just rejected the first one, right? Could you advise me if i should just wait or are they waiting for me? This is taking a long time...I submitted stuff initially on November 18 I think...it's now closer to the 2nd month and Im not sure if this is normal or im just impatient. P.S. I was also thinking that I can just email the embassy directly my new joint sponsor AoS so that they can get it before my husband goes to his interview because i heard that sometimes they make their decision before the interview. I hope that this would be alright things to be doing. I want them to have all of my husband's docs before he goes in especially the financial ones.

P.S. Is it ok not to include w-2 in AoS because I just realize that I didn't see it in the file she forwarded me from her accountant..there's bunch of schedules and other tax forms that i have for 2018 but no where do I see written w-2 in the cover page of her taxes from her accountant and there's no w-2 in ehr taxes although she made around $87K+ for last year. Will the consulate request the W-2 form or all the tax forms and schedules are enough? I even put the cover sheet of what's included in the tax return with the tax docs.

If they accepted your AOS as it is currently then don't change it at the NVC but have your husband bring a joint sponsor to the interview.  It's possible that the CO may reject your AoS and ask for a joint sponsor.

ok thanks...but do you think it''s also a good idea to send the joint sponsor AoS by mail directly to the consulate in advance once we get the interview date. I say this because I heard that the Co already knows whether he or she will deny or not, so i guess im a little freaked out since i rather him/her get the joint sponsor docs in advance to look at to at least make up his/her mind during the interview.
