It's going to be pretty hard to get an update with visa issued when they can't put it in his passport. It will stay in AP until they get his passport back and review again before they issue it.

A "denial" is just another word for refused here. It does not indicate any substantive difference.

Ah. I thought a refusal isn’t a denial, just the issuance is refused until sufficient steps are taken further, whereas a denial is an outright closure of the case and the visa is not issued and the process must be restarted.

That’s what I read on Quora also. They say there that refusal and denial are two different things. Refusal is permanent where an outcome can be either way, while  denial is final.

In this case I suppose the Embassy e-mail us asking for his passport ?

Not impossible but I wouldn't expect any part of immigration to bend over backwards to let me know anything, if you do get the passport back the best bet is just to return it back to the embassy himself when he comes back from the US because I wouldn't count on them reaching out to ask for it

  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Its a risky move to ask for the passport back. You don't know what kind of checks they are doing and it could very well be that they will have to restart the AP process.

They have his dossier consisting of all necessary documents plus a lot of unnecessary ones, too. What does his passport got to do with it?

If they were, for example, to be examining his travel history, him having his passport back opens the door for more travel that could need to be investigated. Not saying that its the case here, but just a potential scenario.

When you feel you have nothing to hide, when you gave them what they asked for, when you believed them that “as soon as we receive this document, the visa will be issued within a week”, when they reassured you that they “do everything possible to help keep families together, especially for holidays”, and that our case would be “a priority”, and still there is no progress, and the CR2 case was not even looked at since the date of the interview, you can’t help but feeling angry, to say the least. We refuse to sit and do nothing and continue endure this abuse.

If they think something is still missing, why  don’t they just reach us and ask? We would be more than happy to provide it. Like I said, we have nothing to hide. 

It makes no sense to ask for Police Certificate of a child who is less than 16 y.o. and who had never had any problems with the law. Yet we provided this document and the Embassy confirmed they received it. Then why the child’s case still has no updates?
