EAD/Green Card

Hi, We are scheduling our interview hopefully by EOM. That being said, we are trying to plan a trip this summer but nervous to as we dont know if my fiance can travel until he gets his EAD/Green Card. Not sure the difference and if England even has that, but wondering if anyone knows the rules on that? I know once he is here, get married, apply for adjustment of status/green card, he cant leave the country until that he gets it. Any information regarding this EAD thing or does he have to wait until he gets the green card in his hand to legally leave the US? So hard to plan life :(

He can travel with AP, takes about 6 months once you file to adjust.

 

Maybe very late summer?

AP which is short for Advanced Parole. It is the document that allows the holder to travel into and outside the USA until they get the actual greencard.

Is that a different filing process than applying for the green card once we get married?

Fees for EAD/AP will be waived if filed with AOS. The guide section has a good overview of that. 

Don't expect a speedy arrival on the EAD/AP though, so don't make plans you can't keep.

Well it is something you file for when you file to adjust.

What is difference between EAD/AP? What does EAD stand for? Again, you apply for green card AND EAD when you apply for adjustment of status?

When you file your AoS packet, you can include both EAD and AP forms and materials needed.

 

EAD - employment authorization. Will allow your spouse to work when it gets approved

 

AP - Advanced Parole: Travel Authorization

I wouldn't bet on it. If your fiance does not even have the K1, by the time he gets the visa, then he travels here, marries and you file for AOS/EAD/AP, it will conservatively be mid-March at the earliest? Then count upwards of four-six months from March 2020 for the EAD/AP. It is a combo card by the way. Will get him an ID/Drivers License for one year and entry back into the USA for one year. Have to renew after 9 months or so.

You need to read the guides

AP = advance parole, allows travel until the green card is approved (or until it expires)

EAP = employment authorization document, allows immigrant to work until the green card is approved (or until it expires)

AOS = adjustment of status, the application filed for the green card

 

All three applications should be filed together

We will read the guides, We just havent gotten there yet as we are working on gathering all the documentation for the interview which as we all know is a lot of work. Thanks for the responses.
