Oh, it's not my W-2 they asked for, but another relative's who is standing as my joint sponsor. I also thought they didn't need the W-2, but apparently they did, though from other members' responses here, in their cases the W-2 wasn't needed. Unfortunately, the message sent to me by NVC just stated the need to upload the W-2, no reasoning given on their end, so I'm also clueless as to the why. Haha! 😅

Hi guys, we are at the NVC stage. Please I have a question regarding joint sponsor. So we are using my father in law as joint sponsor, he files taxes jointly with his wife but only his income is way more than the poverty guideline, So we are using only his income. Does the wife need to still fill form i-864a?  

If yes do we add her I-864a in the additional  documents section of joint sponsor or as household member? Their lawyer is insisting we don't have to fill for her, so I was wondering anyone else had a similar case and what they did.

Note: we are not using any of her income to qualify but he files taxes jointly with her.

You may find this helpful. I am the f2a petitioner in my own case. I am currently unemployed. I used my mum s income as household member and she also files jointly with my dad. So this is what i did: i filled i864 and attached my tax transcript plus proof of my mum's ongoing income , mum filled i864a, dad didnt fill anything but i included mum's w2 so they know how much she made as an individual. I got DQ on my 1st submission.

I would have wife fill out I864a anyways. They prefer to have the spouse fill out I864a regardless, and they may request it if you don’t send it the first time, so I would just go ahead and have her fill it out and submit it anyways. Just one more thing you can do to make sure you get DQ first time because with NVC it’s “better safe than sorry”. My moms I come doesn’t qualify either so my dad was joint sponsor, we included my moms income anyways

To update your timeline , you can do it going on your VJ profile to modify it and then complete the line « case complete at NVC »
