For someone who doesn’t work and is the petitioner, what would be the needed documents?  I’m the petitioner for my husband’s I-130 and I don’t work.  I will have a joint sponsor, but for my I-864, since I live overseas and don’t work, I don’t fill out taxes.  What am I supposed to submit in place of tax transcripts?  NVC still hasn’t received my case, but trying to prepare everything in advance.  How far back do they ask for w2 forms?  I filled out taxes for the last time in I think 2016, but I quit my job to work on my Master’s degree.  Thanks!!!

Living abroad you are required to file taxes every year, even if you don’t work or made below the minimum. Only the most recent tax year (2018) is required. You can write a signed and dated statement stating why you didn’t file but they may request it still since you live abroad and are required to file regardless. But I would upload the statement first, and then in the meantime try to file/amend 2018 taxes (even though you didn’t work since you live abroad) so that you have them just in case. Usually if one didn’t work taxes wouldn’t be required but since those abroad are required to file no matter what, I would have it prepared just in case

  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Well, 7 weeks later and definitely did not get good news from NVC. Actually I would consider this review a complete failure. I'll share all my mistakes to hopefully prevent others from making the same. 

 

1. I have no clue what's up with my Tax Transcript / Return document. I have never filed taxes as I have always been a student and now recently am unemployed (even when I did have a student worker job, I made way below the requirement to file). As such I had uploaded an Explanation of Not Filing with evidence two times--one under the required Tax Transcript / Return document and another under the Additional Documents for the specific type of document "Explanation for Not Filing Taxes." Both of these documents were technically accepted but now they are both under Additional Documents and under the same Document Type. The Tax Transcript / Return document is marked as missing and I have no clue what to do. 

 

2. One of husband's police certificates was rejected because it did not meet the requirements of being "from a correct issuing authority." We aren't for sure what this means but I think in Argentina there are two types of certificates one "con excepción al artículo 51 del código penal." And I am assuming what we submitted does not include that annotation so that means requesting that and waiting to get it translated 😭

 

3. Finally, which this was an issue another member had in this same thread I believe (and I remember reading it and thinking, "oh no. I wonder if this applies to me?" and SURE ENOUGH), my joint sponsor was rejected because she technically should have filed the i-864A. Basically, it's my mother and I didn't realize since she and I technically share the same physical address she needed to file as a household member and not as a joint sponsor. 

 

So, like I said, complete failure on my part with the first round of NVC. This will take a few weeks to get everything together and sorted out and then I'll hope that round two doesn't last as long but I certainly have no hope that it will be any shorter. This process has taken years off my life lol. I hope y'all can learn from my mistakes at least (and if anyone has had the same issue as #1, please help). Good luck and I hope you all get DQ'd the FIRST TIME! lol

Aw no Im sorry. 

We actually filed i864a instead of i864 as my FIL (joint sponsor) and my husband have the same address, but we did this against the advice of a veteran member of VJ 🙊 because that's what the travel state website said.

 

But looks like it used to work before that way, as in every job I'm sure managers realize employees forget to follow certain rules and have probably enforced the use of i864a for household members. That or NVC has a bunch of new people who have revisited rules that had not been followed lately.

This site has good info on which I-864 form you will need to file depends on who your joint sponsor is, there are different rules. There are also different rules for which document you will need depends on who your sponsor is and employment situation - please see 'Obtain financial evidence.' 

 

So if I read the instruction correctly, it says that you will need to write a statement why you did not file taxes for the most recent tax year - in this case, because you are a student.

 

As for tax documents, only the most recent year is required, your joint sponsor should provide this since you do not work.

You may want to call them on this one. Sometimes it’s impossible to know what they want unless you ask them directly because they really don’t explain anything well in their instructions

Pretty sure, you still need to file exemptions for the tax years when you weren’t working, domicile might be another issue since you’ve mentioned your residing overseas...

My wife is migrating from Ethiopia, and we received our case complete email on 12/13/2019.  Does any one know how long it takes for NVC to schedule the interview? Does scheduling take different time for different countries?

Yes, it depends on the country. There’s a Case Complete to Interview thread here, they also have a spreadsheet where you can view peoples timelines from CC to interview, not sure how many Ethiopians on the spreadsheet but worth a look
