Our 2nd year anniversary is April 19th. I've been wondering about all this. We hired immigration laywer to help us so he likes to go one step at a time and not get ahead of ourselves so he hasnt discussed much about the status change once he gets here. Is it difficult and long and drawn out to do that? More money? Are their downsides if we dont wait till our two year? I really dont think either of us wants to wait. But I'd like to understand better

Interview Feb 4th and our 2 year anniversary is Feb 10th! So good timing.

 

So through all the delays and stress...the silver lining is I will get 10 year green card at POE.

Well if that's your wedding anniversary and it's so close wait until April 19th  for him to enter the US if you want to.

 

There is no status change your husbands will be a Legal Permanent Resident when he enters the US. If he enters before your 2 year anniversary 21 to 24 months after he enters you will fill to remove conditions on his 2 year green card to get the 10 year green card.
If he enters after your 2 year anniversary he will be issues the 10 year green card and no need to remove conditions.

 

whether 2 or 10 year he is eligible to file for citizenship 3 years from his entry.

 

Of course every petition cost. I-751 right now is $680 (That includes biometrics).

 

Is there a down side no just more paperwork, and money. Nothing more.

Yes it is still permanent residency. But it is a 2 year conditional green card instead of a 10 year green card meaning 2 years after arriving in the US you have to remove the conditions on the green card to receive a 10 year green card 

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
