Visiting the US on ESTA

Hi,

 

Long story short, we won the green card lottery but due to family commitments we are in the process of surrendering our green cards. We registered these under our British passports.

 

My question was, could I apply for an ESTA on my Irish passport and enter with this? Sadly the USCIS misplaced our green cards when sending them out to us.

 

I hope I have explained that enough.

cheers, not yet just waiting to file my 2019 tax return then will get it filed. Think they said it’s a 2 month turn around.

The ESTA questions apply to you as an individual, and are not specific to the passport you have used or are currently using. So you can apply with either passport but need to answer the questions properly. You won’t get an ESTA approved before you have surrendered your green cards, as you will still be considered LPRs until then.

I just had a look at the i407, I don’t see any question asking about taxes? Are you sure you need to wait for the tax return to be processed before filing?
