K1 case transfer from California to Vermont

Hello community, 

 

Just curious as to which petitions get transferred from the California SVC to the Vermont SVC. I understand, that it could be related to the criminal history. However, what is the common denominator for the cases that are transferred. I read somewhere on here that only petitions with criminal history/ arrests that fall under AWA get transferred for further investigation. Is that true?

Case s are transferred to normalize the load across the processing centers.  Some petitions are specifically processed in certain centers while others are sent to centers that have resouces.

It's impossible to know every reason an I-129F for a K-1 gets transferred to VSC. But by far the most common one seen is anything that could be related to AWA offenses.

VSC is also the SC that handles more "complex" cases for other forms, such as abuse-related ROC, VAWA, etc. It also tends to handle cases involving spouses who married while being minors, IIRC. None of that applies specifically to K-1 cases, but it does tend to imply they handle cases that are more difficult or complex than normal.

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

In your previous post, you stated that it was 'dating violence,' so in that case it would fall under VAWA, and understandably transferred to VSC.

You're only guessing here. Other petitioners with multiple DV charges had their casses processed in California :)

That may be the case, and that guess is based on reading I've done here and on the USCIS website.  

 

But I'm not guessing at the inclusion of dating violence in the VAWA act.  Just re-read it, and it is definitely there.  😊

So is dating violence. Again, people with multiple DV charges and convictions had their case processed in the CSC. Each case is unique. My arrest was not significant/ minor in nature. I was never convicted.  I do not see it going to VSC for that reason. However, you never know - just like you don't know :)

The op is filing for a k1 visa. VAWA Has no relevance to seeking a k1 visa.

Could be a name match for someone else with a similar name to yours that did commit an awa offense. I have seen this happen before.
 

if that is the case you will  get a notice to complete biometrics and they will sort it out from there.

Received NOA1 April 2019

K129f California service center.

On July2019 our petition was transferred to Vermont service center.

Still waiting for approval or RFE
