You had better check the validity date on your K1 where it says valid until, and if you have an entry stamp/I94 that shows you entered after the visa was expired, you should leave the country now as you are accumulating unauthorized stay. They will go back and check your whole immigration past, and if the first step was you entered on an invalid/ expired Visa, your done. But, hey, ride it out and let us know how it goes.

My visa was not expired. I did the medical in March, got the visa in May and entered in October. My I-94 shows I can stay until January but I am already married and sent papers for AOS.

The consulate made a mistake on your expiration date, it seems.  What is the expiration date on the visa itself?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No offense, but consulate employees make mistakes.  K-1 visas are valid for 6 months from date of the medical......

Let me make this simple.  Medical exams are valid for 6 months.  Embassies/Consulates don't have the power to extend that validity.  K-1 visa expiration is limited by the medical expiration.

Then I guess both the embassy and the CBP officer made mistakes?

I love how stubborn people here can be sometimes. Not all cases are the same, even medical examinations in the same country with the same doctor can be different from one another (I know for a fact). Maybe there are certain immigration or country specific rules that members of this forum are not aware of? I am not making up information, this was my process and I am in the US right now. My medical envelope was also open (glue dried over time) when I came in and no one asked any questions.

Thank you for your simple explanation. I will be sure to update if any issue arises.

(sorry OP for taking over thread, was just trying to share my experience in relevance to your situation)

So it sounds like your fiancee is attempting to jump through hoops in the middle of a k1 immigration process to try to attend his sister's wedding in June in Australia.

 

I am curious, will she be attending your wedding in the USA, presumably this spring?

 Not only are we delaying his arrival for his sisters wedding, he wants me to change our potential wedding date (july 29) in Alaska so his sister can come, but if we pushed it to September for HER, most of our guests couldnt come because of work, school etc.  gotta love family huh

Speaking from my own experience, the first six months of marriage and life together in the USA were extremely stressful - more stressful than the 1.25 years of waiting for a visa/gc. Had we had something like what you're experiencing, i.e. accommodating a sibling's wedding and his/her attendance at our wedding, our marriage would likely have failed. The straw that breaks the camel's back. We like to think of relationships as mutual sacrifice, unconditional love, etc. But just like any other relationship, e.g. family members or co-workers, power dynamics come into play. Seems to me your spouse to be is exerting a large amount of power in your relationship right now. You might come to resent it in the future. You might consider a 3rd party (online therapist) to mediate right now.
